확대된 저작권 집중관리제도에 관한 연구

Extended Collective License System is a solution for rights clearance in certain cases of mass uses of protected copyrights. Extended Collective License System has been existed in the Nordic copyright laws since the early 1960s, first in the field of broadcasting. Extended Collective License System means the provisions in the law giving an extended effect to the clauses in a collective agreement in specific areas of the copyright/related rights field. The extended effect applies to right-owners who are not members of the contracting organization. Thus it is an interesting model for countries such as where rights holders are well organized and informed, and where much of the material that is the object of licenses comes from foreign countries, for which it is often more difficult and time-consuming to obtain an authorization for use. The extended Collective License provides a legal solution to this situation, as the agreements struck between users and rights holders will include all non-extended domestic and foreign right holders. Finally, by accelerating the acquisition of rights, the extended collective license also increases the efficiency and promptness of royalty collection. The extended collective license is an appropriate way of solving the difficulties in obtaining copyright clearance in certain situations of mass uses where there is every need to find appropriate solutions to satisfy both right-owners, users and the society at large. But the licensing scheme must, however, fulfil certain conditions. Therefore, more research and data is needed to establish the Extended Collective License, especially in the field at the education and broadcasting first.
