변호사와 의뢰인 간의 법조윤리에 관한 고찰 ―미국의 Sarbanes-Oxley법 등을 중심으로―

This paper attempted to study on the legal ethics. because recently the discussion concerning to the legal ethics is plentifully developed. And the law school is opened in Korea and the main body is changed by the law, so the necessity of legal ethics is becoming higher than in the past. So I want to study the development direction in legal ethics and wirte about one part of it, namely the relations of the lawyer and client in American situation. By this study, I can find the various principle which relates with the lawyer and client from the American law. And I had a chance to observe the Sarbanes-Oxley law of the United States. It`s providing the important thing relating with a an expert`s confidentiality about the client and etc in the United States. And with the different relation laws, it give us the attorney-client privilege law, the work product doctrine and th lawyer`s ethical duty of confidentiality. So I composed this thesis as follows. ChapterⅠ. Introduction ChapterⅡ. the main subject 1. The American`s norm relating confidentiality between attorney and lawyer. 2. The Rules of Professional Conduct Review of Washington D･C relating con- fidentiality. 3. The Gatekeeper Intiative. 4. The Washington D･C`s matter of importance of the new rules of Professional Conduct Review about confidentiality and the fact which becomes from the ABA. 5. The various principle which relates with the lawyer from the American law.
