인터넷 법률사이트에서의 변호사윤리문제의 고찰

초록
인터넷 법률사이트는 현행 변호사법상 법률사무소와 어떤 관계에 있는지, 비변호사와의 동업금지, 알선금지 조항과 어떤 관계가 있는지 등 여러 가지 법률상 문제가 있다. 인터넷 법률사이트는 그에 참여하는 변호사를 기준으로 보면 항상 변호사법위반의 문제가 제기되고, 최근 제정된 인터넷광고기준에 의하면 변호사위규의 문제도 대두된다. 로마켓 사안에서는 비록 검찰이 변호사법위반에 대하여 무혐의결정을 하였지만, 변호사윤리위반의 문제가 완전히 가시는 것은 아니다. 특히 최근 제정된 인터넷광고기준에 의하면, 변호사는 변호사 아닌 제3자가 운영하는 법률사이트에서 운영자에게 사용료 등 명목을 불문하고 어떠한 이익을 제공·약속하는 것도 허용되지 않는다고 규정되어 있기 때문에, 항상 변호사윤리위반의 문제는 발생될 수밖에 없다. 오늘날 인터넷시대를 맞이하여 인터넷의 법률사이트, 인터넷 법률사무소, 사이버로펌의 활성화를 위한 입법적인 뒷받침이 반드시 필요하고, 인터넷 법률사이트에의 참여를 원천적으로 금지하고 있는 인터넷광고기준은 합리적으로 개선되어야 한다.
Abstract
Internet Law Sites have legal problems such as the relations with current law offices, prohibition from doing business in partnership with non-lawyers according to the law now in force. In Internet Law Sites, there are violations of the law usually in a situation of lawyers taking part. The new Internet Advertisement Standards enacted recently brings the problems of infringement on Lawyer Regulations. In the case of 'Law Market', the prosecution decided acquit of violation of the Law but the problems related to ethics of lawyers still remain. Particularly by new Internet Advertisement Standards, a lawyer can not take any profits such as charge or agreement in the sites being managed by non-lawyers. The Standards will raise constantly the problems of infringement on moral principles. Facing the age of Internet, we have to enact the new laws to revitalize Internet Law Sites, Internet Law office and Cyber Law Firm, and Internet Advertisement Standards that fundamentally prohibit lawyers from participating in Internet Law Sites ought to be reformed reasonably.
