개성공업지구 노동분쟁해결을 위한 제도적 틀잡기에 대한 연구

This is the time when the economic exchange between south and north Korea having been initiated in 1990s may deemed to have got into smooth water. The economic exchange, however, would still go insecure from time to time due to the unique relationship between south and north Korea. One of potential factors, though still not coming up to the surface, is the labor problem. Until now, Article 48 of the Labor Regulations for Kaesong Industrial District is the only regulation governing the settlement of labor dispute concerning performance of labor in the Kaesong Industrial District among various laws of south and north Korea. It is known that they have tried to settle the dispute through unofficial arbitration. Under existing circumstances where the number of workers on the north side is over thirty thousand, the current unofficial labor dispute settlement system should soon be confronted with limits, when, for example, the number of labor disputes increases. It is important to grope for and materialize institutional labor dispute settlement system. Accordingly, this paper tries to frame the institutional labor dispute settlement in Kaesong Industrial District. The frame of arbitration procedure this paper suggests are the arbitration led by Kaesong Industrial District Management Committee in the short term, and forming an independent labor arbitration system in the long run.
