행정기관의 여성노동분쟁처리 현황과 과제

Korea has considerably legislated for woman workers for many years but the status of women has not been advanced in workplace. This research defines that labor disputes for women are things related to acquirements of legal rights based on protection of maternity, reconciliation work and family, sexual discrimination and harassments. Labor dispute resolution services are provided by The Ministry of Labor, The Labor Relation Commissions, and The National Human Rights Commissions. But those government agencies deals with limited affairs focused on harassments in labor disputes for women. Capabilities of government services should be developed and improved in order to resolve the labor dispute for woman workers consisted of contingent, non-organized, low-level, and small sized - firm laborer, and considered cases included the individual rights dispute. Therefore, the empowerment of role in the labor dispute resolution of “The Minister of Labor”, coordination of roles between ‘The human rights commissions’ and the labor relation commissions, an adoption of mediation that a relatively informal process in which a third party facilitates mutual decision making between parties to a conflict will be the effective strategies improving the labor dispute resolution system for woman workers.
