초록
FTA는 국제화의 큰 흐름으로 자리 잡아 가고 있는 것이 현실이고, 우리나라도 동시 다발적으로 많은 국가와 FTA를 체결하고 있다. 전 세계적으로 교육시장이 개방되고 있고 교육경쟁력을 갖고 있는 국가에 학생들이 유입되는 상황에서 우리나라도 세계적 흐름을 거역하기는 어려울 것이다. 본고에서는 교육 분야의 다양한 서비스 가운데 고등교육서비스 관련 FTA내용을 크게 국경 간 공급, 해외소비, 상업적 주재, 자연인 이동 등으로 구분하여 고등교육의 국제화를 제한하는 규제들에 대한 보완, 폐지, 신설 방안을 검토하였다. 이를 위해 첫째, 국제협상의 기본이 되는 양자간 및 다자간 협상의 주요 내용과 개념을 이론적으로 검토하고 유형(Mode)별로 고등교육분야의 대표적 기관인 대학과 관련된 F교육서비스의 일반적 특징 및 쟁점들을 정리하였다. 둘째, 우리나라와 미국의 FTA를 중심으로 고등교육서비스분야에서 양자 간 협상을 통해 체결한 유보사항들을 정리하였다. 마지막으로 고등교육교육서비스 개방과 관련해서 우리나라 대학을 규제하고 있는 법령을 유형별로 분석하고 규제의 개선방안을 제시하였다.
Abstract
As FTA is currently becoming a major trend in terms of globalization, Korea is entering into agreements with many nations simultaneously. Korea may face with difficulty to against international trend which leads opening of education market and flowing students into nations with competitive edges in education. This article reviews legal provisions which inhibits Korea from globalization of higher education among other education services according to the 4 modes of FTA, cross-border supply, consumption abroad, commercial presence, and movement of natural persons. Chapter II reviews the content and concept of bilateral and multilateral agreements and analysed general characteristics and issues related to higher education according to the FTA modes. Chapter III reviews bilateral agreements in the area of higher education entered into by Korea and the U.S.. Chapter IV analyses legal provisions by modes related to the opening of higher educational service and suggests policy implication to improve current regulations.
