건물의 소유자와 점유자가 다른 경우에 있어서 대지의 점유관계

사회통념상 건물은 그 대지를 떠나서는 존재할 수 없는 것이지만, 우리나라에서 건물은 법적으로 그 대지와는 별개의 독립한 부동산이다. 판례는 종전부터 건물의 대지가 된 토지는 그 건물의 소유자가 점유하는 것이며, 건물소유자가 현실적으로 건물이나 대지를 점거하고 있지 않더라도 건물의 소유를 위하여 그 대지를 점유하는 것으로 본다. 그런데 타인의 토지 위에 존재하는 건물을 건물소유자 이외의 제3자가 권원 없이 점유하고 있는 경우에 건물점유자도 건물소유자와 별개로 그 토지를 점유하는 것으로 볼 수 있는지 여부가 문제된다. 구체적으로 이 문제는 ⅰ) 토지소유자가 건물점유자에 대하여 물권적 청구권을 행사할 수 있는지 여부, ⅱ) 건물점유자의 부당이득반환 범위 및 그 상대방, ⅲ) 건물점유자의 대지시효취득 여부 등과 관련되어 있다. 학설은, 건물을 점유사용하는 자는 당연히 그 대지를 점유사용한다고 보는 입장과 건물을 점유사용하는 자는 토지를 사실상 이용하는 것임에는 틀림이 없으나 그것은 토지에 정착하고 있는 건물을 점유사용하는 것의 반사작용에 불과하며, 건물소유자와 별개 독립하여 토지를 지배하고 있는 것은 아니라는 입장으로 나뉘어 있다. 이 점에 관한 판례의 입장은 일관되어 있다고 볼 수 없다. 건물소유자에게 대지사용권이 있는 경우에는 건물점유자가 건물소유자와 별개로 대지를 점유하는 것은 아니라고 해야 한다. 따라서 대지소유자는 건물점유자에게 직접 건물로부터 퇴거할 것을 청구할 수는 없다. 건물점유자는 대지소유자가 아니라 건물소유자에게 차임 상당액을 부당이득으로 반환하여야 하는데, 이 때 건물의 차임과 대지의 차임을 따로 계산하는 것이 아니라 대지의 사용관계를 고려한 건물의 차임 상당액을 계산하면 된다. 건물소유자에게 대지사용권이 없는 경우에는 건물점유자가 건물소유자와 별개로 대지를 점유하는 것이라고 보아야 한다. 따라서 대지소유자는 건물점유자에게 직접 퇴거를 청구할 수 있다. 건물소유자와 건물점유자는 대지소유자에 대한 관계에서 대지를 공동으로 불법점유하고 있다고 보아야 하므로, 대지소유자는 건물소유자와 건물점유자 중 누구에 대하여서나 대지의 차임 상당액의 반환을 청구할 수 있다. 건물소유자는 일정한 요건이 갖추어진 경우에 대지의 소유권을 시효취득할 수 있다. 판례는 건물의 소유명의자가 아닌 자는 실제로 건물을 점유하고 있더라도 대지를 점유하는 자로 볼 수 없고, 건물점유자는 대지를 시효로 취득할 수 없다고 한다. 그러나 이 경우에는, 건물소유자에게 대지사용권이 있는지 여부와 관계없이, 건물점유자에게도 대지의 점유와 시효취득을 인정하여야 한다.
Abstract
The common social idea is that a building cannot exist apart from the plot it stands on, but in Korea, buildings are separate real estate from the land they occupy. The precedents have long been that land upon which a building stands is occupied by the building owner, and even if the building owner is not actually occupying the building or the land, the land is his to occupy because of his building ownership. However, regarding a situation in which a person’s building exists on another person’s land, and a third party occupies that building without title, it needs to be determined whether the building occupant can be seen as occupying the plot separately from the building owner. Specifically this problem involves ⅰ) the status of landowner’s claim to repossess as a holder of real rights against the building occupant, ⅱ) the scope of building occupant’s restitution against unfair profit and the opposite party, and ⅲ) the status of building occupant’s acquisitive prescription of land. Scholarship is divided between ⅰ) the view that a person who occupies and uses a building is naturally occupying and using the accompanying land, and ⅱ) the view that, although the person is doubtlessly using the land, it is merely a reflex of the fact that the person is occupying and using the building located on the land, and the person is not occupying the land separately and independently from the building owner. On this point, the precedents are inconsistent. When a building owner has the right to use the land, it must be said that the building occupant is not occupying the land separately from the building owner. Accordingly, the land owner cannot request directly for the building occupant to vacate the building. The building occupant must restitute a large portion of rental fee as unfair profit to the building owner and not to the land owner, and at such time, the rental fee is not calculated separately for the building and the land. Instead, a large portion of the building’s rental fee can be calculated with consideration to the land usage relationship. If a building owner does not have the right to use the land, the building occupant and owner must be seen as occupying the land separately. Accordingly, the land owner can directly request the building occupant to vacate the building. The building owner and occupant both must be seen as illegally occupying the land in their relationship to the land owner, and thus the land owner can claim restitution for a large portion of the rental fee for the land to either the building owner or the occupant. The building owner can have acquisitive prescription of land ownership under a certain set of conditions. According to precedents, a person who is not the building title holder cannot be seen as occupying the land even if he actually occupies the building, and the building occupant cannot have acquisitive possession of the land. However, regardless of a building owner’s right to use the land, the building occupant’s occupation and acquisitive possession of the land must also be recognized.
