한국 노인범죄의 실태에 관한 연구 -형법범계를 중심으로-

다른 국가들보다 빠른 속도로 진행되고 있는 고령화현상은 한국사회에서 많은 문제점을 발생시키고 있다. 그 중에서 노인범죄에 관한 것이다. 노인범죄는 아직은 미약한 수준이지만 다른 계층의 범죄가 감소하고나 정체되고 있는 것에 대비하여 지속적으로 증가하고 있다는 사실이다. 고령화현상은 어느 국가에서 발생할 수 있지만 그 속도와 비중이 점차 증가되고 있다. 따라서 본 연구에서는 노인범죄의 실태를 통계자료를 중심으로 최근 10년간의 노인범죄 실태를파악하고 이를 토대로 한국의 미래범죄의 경향을 예측하고자 한다. 물론 10년 간의 시간으로 미래를 예측한다는 것은 어려울 것이지만 노인인구가 7% 이상을 고령화사회라고 한다면 한국은 2000년부터 고령화사회에 진입했다는 것을 감한 할 때 1995년부터 2005년까지의 분석은 의미있는 분석이라고 할 수 있다. 본 연구의 결과를 살펴보면 첫째, 노인범죄가 지속적으로 증가하고 있다. 다른 연령층인 청소년층과 장년층의 범죄가 감소하고 있는데 반하여 노인범죄 발생은 모든 범죄유형에 있어 지속적으로 증가하고 있는 것으로 나타났다. 둘째, 강력범죄가 지속적으로 증가하고 있다. 특히, 살인의 경우는 형법범계 중 가장 높은 비중을 차지하고 있다. 셋째, 재산범죄가 지속적으로 증가하고 있다. 또한 화이트칼라범죄인 지능범죄가 증가하고 있다. 이와 같은 결과로서 미래의 범죄경향을 예측하면 첫째, 전체적으로 청소년범죄와 장년범죄는 감소하고 노인범죄는 지속적으로 증가할 것이다. 둘째, 노인범죄는 점차 강력범죄화 되어 간 것이다. 셋째, 노인범죄는 재산범죄가 증가할 것이다. 특히 절도범죄는 사회구조적 문제가 해결되지 않는 한 계속적으로 증가할 것이다.
Abstract
The greying society in Korea going on rapidly more than advanced countries brings about many problems. Especially, crimes go through a lot of changes. An analysis of the elderly crimes committed for 10 years, from 1996 to 2005, is as followings. First, the elderly crimes increases continuously. The crimes committed by other ages, that is the crimes committed by the youth and the prime decreases, but the elderly crimes increases continuously in all of the crimes kinds. Second, barbarous crimes increase continuously. When it comes to crimes increase ration, the barbarous crimes of criminal laws increase; robbery(1,150%),arson(637%), and larceny(600%) in order. Especially, murder(8.1%) increases at the highest ratio of all crimes of criminal laws. So, a countermeasure against the offense is necessary. The offence tendency coincides with the elderly crimes tendency. Third, property crimes increase. Crimes of larceny increase at a high ratio(600%) in the offenses of criminal laws. The crimes increases at more than two position figures continuously even in the cities where the crimes increase ration goes down in other kinds of crimes. it coincides with the result of precedent studies. It means that the appearance of elderly crimesis caused by poverty factors and economy factors. In addition, when it comes to elderly crimes tendency, elderly intelligence crimes, white color crimes, increase. The tendency seems to be closely related with elderly physical, psychological, and social traits.
