성매매여성 인권보장법제의 선진화 방안

초록
성매매방지법이 통과되기까지 행정부의 관련부처는 부처 나름대로, 여성단체는 여성단체대로, 국회는 국회대로 이의 통과를 위해 다양한 노력을 하였고 그 결실로서 의미 있는 결과물을 얻을 수 있었던 것으로 평가된다. 성매매방지법은 제16대 국회의 중요한 결실이며, 역사적으로도 큰 의미를 지닌 여성관련 입법으로 기록될 것이다. 그러나 법 시행 이후 여러 가지 미비점이 확인되고 있다. 따라서 다양한 성매매 범죄에 적극적으로 대처하고, 성매매 억지력을 체계적으로 확보하기 위해서는 신종 성매매유형에 대한 법제화 및 관련 법률 정비가 필요하다. 더불어 외국의 입법례에 대한 분석과 관련 판례에 대한 검토도 필요하다. 또한 성매매 근절에 대한 정책은 중앙의 관련 부처만의 정책 영역이 아니라 전 부처 및 지방자치단체, 그리고 국제적 공조를 통해 지속적으로 정책을 이행해야만 어느 정도의 효과를 거둘 수 있는 정책이라 해도 과언이 아니다. 이 논문에서는 여성인권보장의 선진화 방안의 하나로서 성매매 여성의 인권 보장의 문제를 집중적으로 다루려고 하며, 이를 위해 성매매 문제에 관한 국제사회의 입법동향(Ⅱ)과 우리나라의 성매매 관련 법제의 연혁 및 현황(Ⅲ)을 살펴보고, 성매매 관련 주요 판례를 분석․평가(Ⅳ)한 후, 바람직한 성매매 관련 법제 방향(Ⅴ)을 모색하고 결론(Ⅵ)을 유도하고 있다.
Abstract
In order for prostitution prevention act to go through, executive's associated parts, female corporations, national congress made an effort in their own way and from those fruition, it is evaluated to have meaningful results. Prostitution prevention act will be documented not only as the congress's 16th fruition, but also as female associated legislation which holds vast meaning in history. But after the law execution, it has been confirmed that there were several paralysis. So in order to cope with crime related to progressively and to gain perversity of prostitution systematically, new variety of prostitution pattern should be made into law and legislation maintenance is needed. Also analyzing foreign country's legislation and the examination for associated precedent is necessary. The policy for prostitution eradication is not only center associated part's policy field but also every part and local government's policy which is effective only when performing the policy constantly. This dissertation will analyze the problems related to prostitution and go over the legislative movement and grope the right direction for prostitution.
