상황적 범죄예방론에 대한 비판적 검토

이 글은 상황적 범죄예방을 둘러싼 두 가지 질문을 다루고 있다. 첫 번째는 상황적 범죄예방의 실천 윤리에 관한 것이다. 상황적 예방 전략들이 사람들의 이동의 자유를 제약하는 정도, 일상 활동에 대한 감시의 증가 여부, 그러한 감시가 내포하는 여러 가지 문제들을 둘러싼 비판과 항변들, 그리고 수용 가능한 실천윤리의 기본 원칙들이 다뤄질 것이다. 두 번째 질문은 범죄학적 담론과 현대 범죄통제 문화 속에서 상황적 범죄예방이 차지하는 위치에 관한 것이다. 상황적 범죄예방이 범죄의 본질에 대한 사고체계의 변화에 어떤 영향을 미쳤는지, 범죄를 바라보는 전망과 전략의 성격은 어떤지, 상황적 예방의 출현은 후기 현대사회에서의 범죄예방에 관한 우리의 기대에 어떤 영향을 미쳤는지, 그것이 갖는 사회적 정치적 함의들은 무엇인지를 살펴볼 것이다. 상황적 범죄예방의 윤리적․이론적․사회적 측면들을 논하기 위해서 그것에 내포되어 있는 전략, 윤리적 가치, 사회규범과 실천을 둘러싼 다양한 비판과 항변들을 다루고 분석하는 것이 필수적이다. 이 글은 이러한 과업을 목표로 하며 그로부터 도출될 수 있는 몇 가지 중요한 가치들이 제시될 것이다.
Abstract
This article addresses two kinds of questions about situational crime prevention(SCP). The first concerns the practical ethics of situational crime, and about the prospects and strategies for dealing with it? What does the emergence of SCP affect our expectations concerning crime prevention in a late modern society? What are the social and political implications of SCP? In discussing the ethics and the social aspects of situational crime prevention, it is essential to address and analyse the criticisms and the counter-arguments on the strategies, the ethical values, and the social norms and practices which are involved in SCP. This article embarks upon this task, and suggest the value of that undertaking.
