가족내 미성년 성폭력범죄의 실태와 피해자 중심의 법제도적 대응방안에 관한 연구

본 연구의 목적은 한국사회의 가족내 미성년 성범죄가 가지는 심각성을 실증하고, 법제도적 문제점을 개선하고자 하는 것이다. 가족내 미성년 성범죄의 심각성은 관련 문헌과 선행연구의 고찰 및 미성년을 대상으로 성범죄를 저질러 2007년에 유죄판결을 확정 받은 피의자들에 대한 판결문과 범죄경력 조사결과를 통해 실증하였다. 조사결과 가족내 성폭력은 친·의부, 어머니의 동거남과 같은 미성년의 양육을 책임지고 아버지의 역할을 하는 사람들에 의해 가장 많이 발생한다. 또한 피해자 연령이 비친족관계에서 일어나는 성범죄보다 상대적으로 어리고, 범죄의 지속성이 높기 때문에 그 피해가 비친족관계에서 일어나는 성범죄보다 심각한 것으로 나타났다. 때문에 가해자 처벌에 있어서는 보다 엄중하고 일관된 양형이 필요하고, 가해자를 피해자로부터 격리시키고, 안전하게 보호할 수 있도록 다양한 시설지원이 요구되며, 친권을 제한하거나, 심각한 경우에 있어서는 박탈할 수 있는 강력하고 실효성 있는 법집행도 아울러 필요하다.
Abstract
The aims of this study were to: (1) prove the severity of sexual violence crime among family members of children and adolescents in Korean society and (2) suggest the legal correspondence. Accordingly, a review for the related literatures and previous studies, and a survey of criminal records and archival files of sentence for the criminal of that kind were performed for this study. In general, domestic sexual violence was highly likely to be occurred by in-home males such as children's own father, stepfather, and cohabitants with mother who used to care children. The results revealed that the age of victims was relatively younger than that of victims of sexual crime among non-blood family members. In addition, the damage of victims was severer than that of other sexual crime because the continuity of crime occurrence was high. Thus, the punishment for the criminals should be strong and assesment of a case should be consistent. Sexually abused children should be separated from the criminals and cared delicately at the various supporting institute. Parental authority for sexually abused children should be limited and even deprived by the legal authority.
