초록
미국의 위헌법률심판 기제를 설명하기 위한 핵심적 요소이자 특징은 심사의 강도에 차등을 둔 ‘이중(二重) 기준(double standard approach)’의 개념, 그리고 이를 정교화한 다층적(多層的) 심사기준 체계(multi-level system of scrutiny)이다. 최소한의 낮은 심사기준인 합리성심사기준(rationality review; rational-basis scrutiny), 강화된 심사기준인 엄격심사기준(strict scrutiny), 그리고 그 중간 강도의 중도적 심사기준 혹은 중간심사기준(intermediate scrutiny)으로 분류되는, 심사의 강도에 따라 차별화된 위헌심사기준의 정립의 역사와 적용의 실제를 이해하는 것은 오늘날 미국의 위헌심사제도 그리고 미국 헌법상의 기본권 보장을 이해하기 위해 필수적이다. 이중 기준 방식을 기본으로 한 다층적 심사기준 체계는 1930년대의 뉴딜(New Deal) 시기를 거치면서 정립되어 1970년대 후반에서 1980년대 초반에 걸쳐 그 활용과 정교화에 있어 정점에 이르렀으며, 그 후에는 법원 내외에서 위헌심사기준으로서의 이중 기준 방식의 문제점 내지 결함에 대한 비판이 제기되고 이를 극복하기 위한 시도가 모색되면서 오늘에 이르고 있다. 특히 1980년대 중반 이후에는 이중 기준 방식의 경직성에서 벗어나 보다 유연하고 실질적인 위헌성 심사를 가능하게 하는 심사기준의 모색 노력이 미연방대법원의 판례에 나타나고 있다. 이러한 경향은 표현의 자유 및 실체적 적법절차의 영역 등에서 상대적으로 분명하게 나타나고 있으며, 평등 보호의 영역에서는 이중 기준 방식이 가장 원형대로 유지되고 있으나 역시 개선이 모색되고 있다. 이 글에서는 미국의 위헌심판에서의 위헌심사의 기준으로서의 이중 기준과 이를 정교화한 다층적 심사기준의 정립과정, 이중 기준 방식의 문제점 내지 결함, 나아가 이에 대해 제시된 개선의 움직임을 분석함으로써, 미국의 위헌심사기준을 체계적으로 이해하고, 우리에게 주는 시사점을 생각해 본다.
Abstract
Contemporary constitutional adjudication in the United States is characterized by a system of judicial review composed of three distinctive levels of scrutiny that are invoked in the respective spheres, referred to as strict, intermediate, and minimal or rational-basis scrutiny. This multi-level system of scrutiny as employed by the U.S. Supreme Court was established out of the constitutional crisis occasioned during the New Deal era. Through the U.S. Supreme Court’s continual and extensive elaboration, most notably in equal protection clause cases spanning 1950s through 1980s, the system of multi-level scrutiny in the U.S. by now has revealed certain structural flaws. As criticized from both inside and outside the judiciary in the U.S., the multi-level system is a rigidified approach that might hinder proper constitutional analysis in the following respects. First, it might misdirect constitutional analysis by deflecting the focus of inquiry toward abstractions, i.e., the tiers of scrutiny, that might have little to do with the specific merits of a case. It might thus dilute constitutional analysis by using a priori definitions, such as “fundamental right” and “suspect classification,” to trigger the operative tier of scrutiny, thus hampering legal analysis by focusing the inquiry toward abstractions. Furthermore, the multi-level system might impede legal analysis by imposing categories upon the constitutional balancing process. Finally, the a priori categories used in the multi-level system have not always been capable of providing internal stability for the system, as particularly indicated in the equal protection cases pertaining to the suspect classifications. Especially since mid-1980s, the U.S. Supreme Court has indicated increasing deviation from the multi-level approach and has moved toward a less rigidified application of a rather unified standard of judicial review. This conceptual movement has appeared more clearly in the areas of freedom of expression and substantive due process, and, to a much lesser degree, in the area of equal protection. In terms of methodology, there have been more evident departures from the multi-tier system, and, there also has been less blatant deviation from the system accomplished through various means of, for example, upgrading or strengthening minimal scrutiny, downgrading intermediate scrutiny, and carving out exceptions to strict scrutiny.
