Zubulake v. UBS Warburg LLC 사안은 전자증거개시(E-Discovery)와 관련하여 대표적인 역할을 하던 판례 중의 하나이며, 지금도 여전히 의미 있는 판례로서 지속적으로 언급되고 있다. 본 판례에서는 우선 전자적 자료의 접근성이라는 특성과 관련하여 접근성이 현저하게 떨어지는 전자적 자료를 증거개시의 대상으로 인정해야 하는지를 판단하기 위한 기준을 제시하고 있다. 또한 접근성이 현저하게 떨어짐에도 불구하고 증거개시의 대상이 된다고 판단한 경우, 비접근성으로 말미암아 발생하는 과도한 비용을 기존의 원칙대로 당해 자료를 제출하는 당사자가 일방적으로 부담하도록 하는 것은 문제가 있으므로 비용부담의 이전(Cost-Shifting)을 고려해야 한다는 판단 하에 이를 결정을 하기 위한 기준요소들을 제시하고 있다. 본 판례에서 제시된 여러 가지 기준과 이와 관련된 개정 미연방민사소송규칙의 검토는 전자적 자료에 관한 소송법상 취급에 대한 실질적 논의의 필요성을 절감하게 하게 한다. 즉 현재와 같이 단순히 전자문서라는 하나의 유형에 한정하여 이에 대한 논의만 할 것이 아니라 좀 더 넓게 전자적 자료 전반에 대한 논의가 필요하다는 것이다. 앞으로의 논의에 이러한 검토가 하나의 자료로 활용될 수 있기를 기대한다.
Abstract
Zubulake v. UBS Warburg LLC is one of the leading cases which are related to E-Discovery. And this case provides a textbook example of the difficulty of balancing the competing needs of broad discovery and manageable costs. In this case, court provided seven-factor test for Cost-Shifting Analysis: 1. The extent to which the request is specifically tailored to discover relevant information; 2. The availability of such information from other sources; 3. The total cost of production, compared to the amount in controversy; 4. The total cost of production, compared to the resources available to each party; 5. The relative ability of each party to control costs and its incentive to do so; 6. The importance of the issues at stake in the litigation; and 7. The relative benefits to the parties of obtaining the information. And E-Discovery amendments to the Federal Rules of Civil Procedure took effect on December 1, 2006 to address the unique problems presented by discovery of electronically stored information. Reviewing this case and amendments which are related to the issues of it would help to understand the problems caused by electronically stored information and to find some solutions.
