초록
통신산업은 모든 국민들의 의사소통과 정보교류에 필수적인 산업으로 등장하게 되었다. 또한 최근에는 통신·방송의 융합 현상과 같이 종래에는 상상하지 못했던 새로운 통신서비스의 양상이 등장하고 있고, 통신서비스에 대한 국민적 욕구가 증대할 것으로 예상되는 만큼 이 분야에서도 공정하고 자유로운 경쟁이 정착되어야 할 것이다. EU의 2003년 규제시스템은 전기통신과 미디어·정보테크놀로지의 융합에 대처하기 위해 그 적용대상 분야를 전자커뮤니케이션시장(electronic communication market)으로 확대하고 있다. 이는 전자에 의한 전송 네트워크와 서비스를 동일한 기준에 의해 규제하도록 하고 있다는 점에서 선진화된 규제모델을 제시하고 있는 것으로 볼 수 있다. 정보통신산업을 경쟁법 기준에 의해 개별시장으로 구분하고, 각 시장에 있어서 SMP 사업자의 존부를 경쟁법 기준에 의해서 판정하도록 하고 사업법적 규제를 경쟁법적 규제로의 이행 메카니즘을 명확히 하고 있는 점에서 경쟁정책적으로 커다란 의미가 있다. 우리나라의 경우에도 EU에서처럼 통신·방송의 융합에 대비하여 그 규제대상 분야를 확대하고, 정보통신 분야에서의 시장획정, 시장지배력 및 배타적 행위의 부당성 등에 관하여 경쟁법의 보편적 기준이 손상되지 않는 범위 내에서 공정거래법과 전기통신사업법의 공통기준을 마련해 갈 필요가 있다.
Abstract
Telecommunication industry has advanced as an essential industry for communication and interchange of information. Fair and free competition should be settled because new telecommunication service which had not been imagined e.g. fusion of communication and broadcasting emerged and desire for new telecommunication service was increased. Regulation system of EU in 2003 enlarged the scope of application in order to prepare for the electric communication and the fusion of medium and information. The regulation system which regulated transmit network and service by the same standard presented an advanced regulation model. The regulation system is good for the competition policy. It is because the regulation system classified the telecommunication industry as particular market, because the system decided the existence of a player which had SMP by the standard of competition regulation, and because it clearly switched regulatory mechanism from business law to competition regulation. We need to enlarge the scope of regulation preparing the fusion of telecommunication and broadcasting and to set the common basis of Fair Trade Law and Electric Communication Act.
