“對世的 義務” 개념에 관한 硏究 ― 類似槪念과의 比較를 중심으로 ―

제 2 차 세계대전후 UN이 수립됨과 더불어 국제법의 구조가 전통적인 수평적 구조로 부터 수직적 구조로 변모해 가고 있는데, 여기에 중심이 되고 있는 개념이 바로 “對世的 義務”(duties erga omnes)와 一般國際法의 强行規範(jus cogens)이다. 그러나 이들 두 개념은 거의 비슷한 시기에 그 모습을 드러내는 과정에서 양자의 관계가 문제되고 있는데, 본 원고에서는 이들 각 개념의 속성을 비교함으로써 양자의 관계를 분명히 하려고 시도하였다. 또한 “對世的 義務”에 대한 이해를 어렵게 하는 여러 유사 개념들 -즉,命令的 義務(imperative obligations), 當事者間 對世的 義務(obligations erga omnes partes/contractantes), 民衆의 訴(actio popularis), 對世的 規則(rules erga omnes), 對世的 權利(rights erga omnes), 對世的으로 유효한 權利와 義務(obligations and rights valid erga omnes)-등의 개념을 분명히 하고, 이어서 “對世的”으로 번역되고 있는 erga omnes란 라틴어 술어의 多義性에 관해서도 개관하였다.
Abstract
With the end of the World War II and the birth of the United Nations, the international community has witnessed structural change, at the heart of which process two concepts have lied, -to wit, duties erga omnes and jus cogens. These two concepts emerged above the international community at the similar period with the help of ILC or ICJ, while their relationship is still not entirely clear. The primary aim of the paper is to shed light on it. In addition, many concepts which look apparently similar to duties erga omnes have been surveyed, which include imperative obligations, obligations erga omnes partes/contractantes, actio popularis, rules erga omnes, rights erga omnes, and obligations and rights valid erga omnes. Also, it has been pointed out that the Latin expression "erga omnes" could serve to mean many others.
