자배법상 정부보장사업의 적용 범위에 관한 동법 제30조 제1항 제1호 및 제2호는 피해자가 보험가입자로부터 신속한 배상을 받을 수 없는 경우를 예시적으로 규정하고 있는 것으로 해석함이 타당하며 보험에 가입하였으나 보험자가 약관에서 정하고 있는 면책사유를 이유로 보험금 지급을 거절함으로써 보험회사의 보상책임 유무가 객관적으로 확정되지 않은 경우도 정부보장사업의 청구 대상이 되는 것으로 해석함이 자배법의 입법취지와 정부보장사업의 취지와도 일치한다. 이러한 취지에서 정부보장사업자의 보상금 지급은 자배법 위 조항에 따른 법률상의 지급으로 해석되므로 민법 제741조나 동법 제745조 제2항에 의한 부당이득반환청구의 문제는 인정될 여지가 없다고 할 것이다. 정부보장사업자의 구상권과 관련하여 정부보장사업자가 피고들에 대해 가지는 채권은 원래 피해자가 피고들에 대개 가지는 권리를 대위하는 것이므로 피해자가 피고들에 대해서 가지는 본래의 권리가 그 성격과 동일성을 상실하지 않은 채 그대로 정부보장사업자에게 이전하는 것으로 해석해야 한다.
Abstract
The article 30 (1) 1. & 2. in the Guarantee of Automobile Accident Compensation Act deals with the range of application of the Guarantee of Automobile Accident Compensation Business. For the benefit of victim in the automobile accident, the coverage of this article should be widely interpreted. It is submitted that the above article includes the case where the insurer refuses to pay the insured amount on the basis of the exceptions clauses. Therefore after the government pays the compensation money to the victims, the government is allowed to subrogate the victims' right of claim to the wrongdoer. In addition, the government is able to subrogate the victims' direct right of action against the insurer. The government's payment of compensation money to the victims can be said to be legally based on the above article. Therefore, the contention that the government has the right of restitution claim for unjust enrichment based on the article 741 and 745 (2) in the Civil Law is groundless. The rights which the government subrogate originally comes from the victims' rights against the wrongdoers. Therefore, the victim's right is legally transferred to the government without losing the character and identity.
