옹호연합모형을 통한 법학전문대학원제도 도입과정 분석
An Analysis of Changes in the Korean Law School Policy through the Lens of Advocacy Coalition Framework

본 연구의 목적은 Sabatier의 옹호연합모형(ACF)의 적용을 통해 법학전문대학원 제도도입과정을 보다 체계적이고 종합적으로 분석하는데 있다. 분석결과를 종합하면, (1) 법학전문대학원 제도 도입 논의과정 전반에 걸쳐 정책하위체제의 행위자들은, 시장주의, 다원주의를 바탕으로 ‘법률가 공급독점체제 타파’를 주장하는 비법조계(찬성연합)와 국가주의, 엘리트주의에 바탕하여 ‘국가주도 법률가 양성체제 유지’를 정책기조로 하는 법조계(반대연합)로 나뉘어 첨예한 대립을 펼쳐 왔고, (2) 이러한 옹호연합 행위자들의 가용자원과 신념체계는 다양한 외적 변수(지배집단의 변화, 일본의 로스쿨 제도 도입 등)에 의해 영향을 받았으며, (3) 이 과정에서 국회(교육위)와 사개추는 ‘정책중개자’로서 찬성/반대 옹호연합들의 서로 다른 정책선호와 전략들을 중재하여 타협 가능한 대안을 도출하는데 기여하였다. 아울러 (4) 한국과 같이 갈등적 정책사안의 경우 정상적 입법절차가 제대로 작동하지 못하는 특이한 입법문화를 가진 나라에서는, 최근 ACF에서 정책변동의 대안적 경로로 새로 추가된 ‘참을 수 없는 교착상태에서 일어나는 협상에 의한 타협’이 정책변동을 설명하는데 있어 상당한 유용성을 지닐 수 있음을 확인할 수 있었다. 이러한 연구결과를 바탕으로 본 연구는 몇 가지 한계와 함께 정책변동의 분석틀로서의 ACF의 전반적인 유용성을 재확인하면서, 특히 이념적 차이에 따라 근본적인 갈등이 빈번히 야기되는 교육정책 분야의 정책변동 연구와 관련하여 ACF의 보다 폭넓은 활용을 제언하고 있다.
Abstract
The study attempted to analyze, through the lens of Advocay Coalition Framework, the dynamic process of policy formation and changes around a law school system recently introduced in Korea. The study found: (1) actors within a law school policy subsystem have formed conflicting advocacy coalitions based on different belief systems (i.e. market. vs. government involvement; pluralist vs. eliticism); (2) the remarkable influences of the external (system) events on policy formation and change; (3) an important role as a policy broker conducted by the Presidential Commission on Judicial Reform and the Education Committee of the Korean National Assembly; and (4) the usefulness of the concept of 'negotiated agreement', which was recently added to the model as an alternative paths to major policy change, in explaining the decision-making process to introduce a law school system in Korea. Based on these results, the study concluded that the ACF provided a useful analytical framework for analyzing changes in the law school policys and suggests more active application of the Advocacy Coalition Framework in studying education policies which frequently cause irresolvable conflicts based on different belief systems and philosophy.
