표절사례 연구 - 학술저작물을 중심으로 -

Plagiarism is a very important concept because it lies at the very foundation of academic field. It is urgently necessary to establish the standards and guidelines of plagiarism and proper citation. Case research on plagiarism is prerequisite for establishing the guidelines, which should start from copyright infringement, especially “Article 28(Quotations from Works Made Public)” and “Article 37(Indication of Sources).” There are some elements in deciding whether or not it is under plagiarism, i.e., “within a reasonable limit”, “compatible with fair practice”, and “in the manner and to the extent deemed reasonable by the situation in which the work is used.” These are unclear concepts, which should be finally interpreted and determined by courts. This paper deals specific topics or issues stated in plagiarism court cases, i.e., “within a reasonable limit”, “compatible with fair practice”, “in the manner and to the extent deemed reasonable by the situation in which the work is used”, “re-citation”, “self plagiarism”, “co-author”, “reuse of dissertations”, “differences of academic fields”, “time standards of determining plagiarism”, “statutes of limitation of plagiarism”, and “subjects of determining plagiarism”. Through this case research, the author hope the discussions on the issues would be more active, which provides a cornerstone for establishing the guidelines and standards of plagiarism and proper citation.
