Review of 2008 Inheritance Tax and Gift Tax Law Cases

초록
2008년도 상속세 및 증여세법 관련 대법원 판결은 판례공보로 간행된 것이 2건에 불과하였다. 이들 판결은 증여의제와 관련된 것이고, 그 관련 규정은 입법과정에서부터 상당히 논란의 소지가 있었고 대법원 판례 또는 헌법재판소의 결정에 의해 많은 입법적 변화를 거쳤다. 대법원 2008.2.1 선고, 2004두1834 판결은 토지무상사용이익의 구체적 계산방법에 대한 위헌․위법요소를 재확인하고, 대법원 전원합의체 판결 이후 시행되는 구상증세법 시행령 부칙 제14조에 근거하여 구 조항이 아닌 신 조항을 적용하여야 한다는 것을 명확히 하였다. 또한 동 판결은 법령 규정이 무효인 경우를 진정소급효의 예외사유로 인정하였다는 점에서 그 의의를 찾을 수 있다. 대법원 2008.2.14 선고, 2007두15780 판결은 명의자의 의사와 관계없이 실질소유자가 일방적으로 명의자의 명의를 사용하여 등기 등을 한 경우에는 명의신탁 증여의제규정이 적용될 수 없으며, 이 경우 과세관청이 실질소유자가 명의자와 다르다는 점만을 입증하면 되고 그 명의자의 등기 등이 실질소유자의 일방적인 행위로 이루어졌다는 입증은 이를 주장하는 명의자가 하여야 한다는 기존의 판결을 재확인한 것이다.
Abstract
The Supreme Court were decided and published 2 cases regarding the Inheritance Tax and Gift Tax Act(the Inheritance Tax Act) in 2008. This cases are about deemed gift. The Inheritance Tax Act articles about deemed donate property had engendered a lot of controversy from lawmaking and were modified by Supreme Court Cases and Constitutional Cases. First Case[Supreme Court, 2004Du1834(Fer. 1, 2008)] reconfirmed unconstitu- tional and illegal part regarding free use profit of land. It also established applyment of the additional Article 14 of the old Inheritance Tax Enforcement Ordinance to be made since Supreme Court unanimous Case(2001Du5682). And when ordinance is in invalidity, the Supreme Court held to be retroactive. Second Case[Supreme Court, 2007Du15780(Fer. 14, 2008)] reconfirmed existing cases. The Supreme Court held that deemed gift of nominal trust that the actual owner registered to trustee's name one-sidedly without reference to trustee's intention wasn't applied to Article 45-2 of the Inheritance Tax Act. And the tax office does prove that actual owner is different with trustee, the trustee must prove which the actual owner registered to trustee's name one-sidedly.
