신용장거래에서 불일치서류의 거절통지에 관한 연구

국제상업회의소의 부단한 노력의 결실에 의하여 1933년에 제정된 화환신용장 통일규칙(UCP)은 그동안 신용장통일규칙은 국제상거래를 활성화하는데 지대한 공헌을 하여왔으며, 그동안 국제상거래관행의 변화와 동 규칙적용 상 나타난 제반문제점을 보완하기 위해 그동안 6차례 개정되었다. 2007년 7월 1일부터 시행되고 있는 제6차 개정 UCP(UCP 600)은 모두 39개 조항으로 구성되어 있다. 이에 본 연구에서는 UCP 600 제16조에 규정하고 있는 불일치서류에 대한 거절통지와 관련된 문제를 중심으로, 불일치서류에 대한 수리거절과 교섭권 활용, 거절통지의 구체적 방법과 기간, 상환대금 및 이자의 반환 등에 대하여 검토하였다. 특히 UCP 600 제16조에서는 ‘불일치서류에 대한 거절통지와 취급방법’과 관련한 문제에 대하여 UCP 500의 그것보다 구체적인 규칙을 제공하고 있는데, 실제 신용장거래에서 서류를 심사하는 과정에서 발견되는 불일치를 근거로, 최초서류제시에서 거절되는 비율이 60% 이상에 달하고 있다는 사실을 감안하여 볼 때, 현행 UCP 600 제16조는 이와 관련되는 많은 분쟁 및 법정소송에 있어, 명쾌한 지침이 되어 신용장의 신뢰성을 제고하는데 중요한 역할을 담당할 것으로 생각된다. 본 연구를 통하여 특히 발행은행의 독자적인 교섭권 활용의 유용성 검토와 거절통지에 있어 반드시 수반되어야 하는 제반조치들이 무엇인지 그리고 이와 관련하여 예상되는 문제점에 대한 적절한 접근방식을 제시하였다.
Abstract
Beneficiary must present conforming documents in the documentary credit transactions, bank must honour or negotiate the beneficiary's conforming presentations. But bank determines that such a presentation does not comply, it may refuse to honour or negotiate. In related matters, UCP 600 Article 16 deals with discrepant documents, waiver and notice of discrepant documents and so on. In order to this study, I studied the central theme of UCP 600 Article 16 as follow : ① Refusal to honour or negotiate when a presentation does not comply ② Issuing bank's sole judgement approach the applicant for a waiver of the discrepancies ③ Concrete methods of the notice and its period ④ Claimming of a refund and interest Through this study, I hope that this research could present proper solutions for the various matters expected in related discrepant documents.
