초록
우리나라에서는 1990년대 초반부터 사법개혁의 일환으로 사법개혁위원회와 새교육공동체위원회를 중심으로 법학교육제도의 개혁에 관한 논의가 진행되어 왔으며, 이에 관한 연구 및 개선작업이 진행되어 오고 있다. 최근 일본에서 미국식 법학전문대학원 제도가 도입되었으며, 우리나라에서도 새로운 정부 출범 이후 대법원 산하 사법개혁위원회가 구성되어 법조인양성제도 및 법학교육의 개선에 관해 많은 논의가 이루어 질 것으로 기대된다. 이점에 착안하여 본 연구에서는 21세기 정보사회에 가장 적합한 법학교육방법으로 입증된 영미의 사례 중심적 법학교육방법과 이미 사례 중심적 교육방법을 상당히 수용하고 있는 독일의 법학교육방법에 관하여 심층적이고, 포괄적인 연구를 하여 앞으로 도입될 법학전문대학원 뿐만 아니라 현행의 학부수준에서의 법학교육에 획기적인 전환점을 가져올 수 있는 개선방안을 마련하고자 한다. 본 연구에서는 법학교육시스템과 법학교육의 개혁을 위한 논의로서 현재 우리나라에 존재하고 있는 법학교육기관들이 법조인 양성과정이라는 보다 전체적인 체계 속에서 어떠한 관계를 맺고 있는가를 살펴보았다. 법조인 양성과정에 대해서는 미국, 독일의 시스템과 우리나라의 시스템을 비교, 분석하고, 교과과정 및 교육방법에 있어서도 두 나라의 제도와 우리의 제도를 비교, 검토하였다. 법학교육의 소프트웨어인 교과과정과 교육방법의 문제점과 그 개선방안에 대해서 논의하였다. 특히 법학교육과정에서 기본적인 법지식의 습득과 이를 실무에 적용하는 능력 그리고 전문인으로서의 고도의 공적 책임의식과 윤리의식의 함양할 수 있는 새로운 교과과정의 개발과 법학교육방법론의 개선에 관하여 구체적인 방안을 제시하였다.
Abstract
As a part of the judicial reform in Korea, there has been a discussion on the reform of the Korean legal education system since the early 1990s, and the Judicial Reform Committee and the New Education Community Committee have taken the lead in the reform process. Japan has recently introduced American law school system, and the Judicial Reform Committee has been organized in Korea under the guidance of the Korean Supreme Court after launching the new Korean government. Thus, it is anticipated that a lot of discussion will be made on the reform of the legal training and education system in Korea. In this situation, this Article examined comprehensively the Anglo-American case study method, which was proved as one of the most effective legal education method in the information society of 21th century, and the legal education system in Germany which adopted the case study method in a great degree. Through this research, this Article tried to provide a turning point for legal education on the undergraduate level as well as law school level which will be introduced to the Korean legal education system in the near future. This Article addressed the role of the current legal education institutions in the whole training system for the legal profession. For this purpose, this Article made a comparative analysis of the training system for the legal profession in the United States, Germany, and Korea. In addition, this Article examined legal curriculum and education method in those countries, which can be referred to software in legal education. Especially, this Article made specific recommendations for the following area; (1) learning the elementary legal knowledge and improving the ability to apply this knowledge to the actual cases; and (2) developing the new curriculum and legal education method for fostering responsibility and ethics of legal profession.
