일본 민사재생법상의 주택자금대부채권에 관한 특례제도의 연구

초록
근래 경제상황의 악화로 주택보유자의 주택상실문제도 점점 더 심각해지고 있는데, 이 점은 우리나라만의 문제가 아니다. 미국에서도 이 문제는 이미 심각해져 그와 같은 채무자들을 구제하기 위한 입법이 논의되고 있는데, 본인은 우리나라도 그와 같은 입법조치를 강구할 것인지 검토할 때가 되었다고 본다. 이와 관련하여 외국의 입법례로 가장 참고가 되는 것이 일본 민사재생법의 주택자금대부채권에 관한 특례제도이다. 이러한 점에서 착안하여 이 글은 다음과 같은 내용을 다루었다. 첫째, 국내에 일본의 위 제도에 대한 소개가 미흡하다고 판단되어, 그 내용을 소개하였다. 둘째, 우리나라에도 위 제도를 참고로 한 제도의 도입이 필요한 것인지 여부를 검토하기 위하여 먼저 우리나라의 주택금융제도의 현황에 관하여 통계를 동원하여 검토하였다. 셋째, 이러한 검토를 바탕으로 제도도입의 필요성을 검토하였는 바, 본인은 결국 이 점은 정책적 판단의 문제로, 도입함이 상당하다는 결론을 제시하였다. 넷째, 이어 만일 그와 같은 입법을 할 것을 전제로 하여, 어떤 제도로 구성하여야 하는지, ‘주택’의 의의, 적용대상 채권의 범위의 문제 등 기타 세부사항을 검토하였다.
Abstract
As we are now experiencing the economic crisis, many houses might be foreclosured. It means many owners would lose their houses. It is much the same in the States. The States are trying to make a law to support the owners to be foreclosured. It is the time for Korea to think of making the same law. The very good example to it is “the Status on Home Loan” in the Japanese Civil Rehabilitation Law. This essay touches the topics like hereunder. First, I introduce the Japanese system to Korea, for it has not been introduced enough till now. I explain the detailed contents of the system. Second, I explain the Korean situations of home loan by statistics, because it is necessary for judging whether Korea needs the system like Japanese one or not. Compared to the States or Japan, the long term home loan is relatively less used in Korea. Third, I estimate the necessity for introducing the system into Korea and insist that Korea should need it. Forth and finally, I check some necessary issues for introducing the system into Korea. It is, for example, a part of what procedure it should be.
