한·일 아동학대 관련 법률에 대한 비교 연구

초록
이 연구의 목적은 우리나라의 아동학대 관련 법률의 개선방안을 모색하는 것이다. 이를 위해 우리나라와 일본의 가정폭력 및 아동학대 관련 법률의 체계와 내용을 분석하고 비교하였다. 우선 우리나라의 가정폭력 관련 법률과 일본의 「배우자로부터의 폭력의 방지 및 피해자의 보호에 관한 법률」을 비교함으로써 기본 개념상의 차이가 법체계상의 혼란을 초래한다는 것을 살펴보았다. 또 우리나라 「아동복지법」의 아동학대 관련 조항과 일본의 「아동학대 방지 등에 관한 법률」을 일반적인 법조문의 체계에 따라 총론과 세부적 내용으로 나누어 비교·분석하였다. 그리고 이를 바탕으로 우리나라 아동학대 관련 법제도의 개선방안을 제시하였다. 입법적 개선방안으로, 첫째, 법체계의 정비가 필요하다. 일본의 경우처럼 가정폭력 관련 법률의 규율대상은 ‘배우자폭력’으로 명확하게 함으로써 법체계상의 혼란을 제거할 필요가 있다. 둘째, 아동학대와 관련된 법률의 내용을 대폭 보강하고 구체화할 필요가 있다. 이를 위해서는 기존의 아동복지법을 개정하여 ‘아동학대 방지’를 독자적인 장(章)으로 만들고, 아동학대의 예방, 피학대 아동에 대한 보호·지원, 재학대 방지, 친권 남용 방지 등을 위해 필요한 내용들을 대폭 보강하는 방안을 강구할 필요가 있다.
Abstract
The purpose of this study is to seek ways to reform laws on child abuse in Korea. For this purpose, first, it compared the structure and contents of the Korean and Japanese laws on family violence. This comparison shows that difference of basic concepts causes the confusion of legal system. It also compared the articles on child abuse in Korean 「Child Welfare Act」 with Japanese 「Child Abuse Prevention Act」. Based on this comparison, it suggested some reform measures for Korean 「Child Welfare Act」 to prevent child abuse as follows. First, Korean legal system on family violence needs to be revised in order to avoid conceptual confusion. Secondly, the articles of Korean laws on child abuse needs to be modified and reinforced. For this, the authors suggested the enactment of an independent chapter on 'child abuse prevention' in 「Child Welfare Act」, which strengthens prevention measures against child abuse and re-abuse, protection and support for abused children, family counseling and therapy, legal measures against parental authority misuse.
