정보공개청구권과 저작권의 상충 : 미국의 논의

This is a study on the conflict of the freedom of information and copyright. An outline of this study is as follows : The Freedom of Information Act(FOIA) of Korea emphasizes official agency disclosure through access to official information. However the Copyright Act of Korea emphasizes protection the expression of idea unauthorized exploitation. If someone requests a copyrighted official information disclosure under FOIA of Korea, what should the official agency do? The FOIA of Korea restricts the right of information disclosure request under FOIA of Korea exemption clause, Clause (1) of Article 9. The existence of a copyright does automatically render FOIA exemption information? Is the Copyright Act exemption statue of Exemption 1? Is copyrighted information a trade secret of Exemption 7? These are not obvious. This article analyzes a discussion of U.S.A. about this issue, suggests what a discussion of U.S.A. gives us. Chapter two reviews the FOIA of U.S.A. and the Copyright Act of U.S.A. Chapter three analyzes the Weisberg decision which is the most famous on holding this issue, and chapter four suggests what a discussion of U.S.A. gives us.
