헌법교육의 접근방식과 내용요소

초록
법교육의 주된 목적이 법의식 함양을 통한 시민성 교육이라는 점을 고려해볼 때 헌법교육 은 법교육의 가장 핵심적인 영역이라고 할 수 있다. 그러나 교과교육적 차원에서 헌법교육 은 그 내용과 방향성이 체계화되지 않아 제대로 시행되지 못해왔다. 본 연구에서는 헌법교 육의 틀을 바로 세우기 위해 법교육 관련 전문가들의 견해를 종합하여 헌법교육에서 다루어 져야할 내용들을 확인해보았다. 연구 결과 헌법학 교육과 달리 시민성 함양에 중요한 핵심 요소들을 중심으로 헌법 교육 이 재구조화될 필요성이 제기되었다. 기본권 관련 내용들을 중심으로 이론 및 통치구조론, 사례들이 결합되는 형태를 취하되, 학생들의 흥미와 관심을 이끌어내기 위한 효과적인 교수 학습법이 고민될 필요가 있는 것으로 확인되었다. 또한 교과교육의 차원에서 정치과목과의 중복 문제를 해결하고 국내외 판례 및 결정례들을 교육자료화하는 작업도 필요한 것으로 나 타났다. 본 논문에서 연구된 바를 시론으로 하여 헌법 교육의 목표와 내용에 관한 논의가 보다 활성화될 것을 기대한다.
Abstract
The main goal of LRE is to breed the citizenship by extending legal mind. In this point of view, Constitution Education can be the essential part of LRE. But for now, Constitution Education has been suffered from confusion and indifference. This study means to identify the main themes and contents of Constitutional Education by analysing the opinions of LRE experts. As a result, the necessity to reconstructing the Constitution Education by centering the essential parts of citizenship education has been raised. The contents about fundamental rights could be the core part. Contents for legal theories and institutions, legal cases can be added to this. Moreover, the effective teaching methods and strategies which make student interested and engaged should be developed. The overlap of Constitution Eduacation with Politics is also a serious problem to be solved. Other than that, educational sources like legal cases should be developed and offered.
