역사 드라마의 실존 정치인에 대한 허구적 묘사와 명예훼손 판례상의 법리

이 연구는 실존 정치인이 등장하는 텔레비전 드라마의 허구적 묘사와 명예훼손 성립 여부를 살펴보고 그 판단기준을 제시해보려는 데 목 적을 두고 있다. 이를 위해 1992년 이후 나타난 방송드라마의 명예훼손 소송 판례를 수집, 분석하였고 역사 드라마 작가와 연출가 등 제작진들의 인식과 견해를 함께 알아보았다. 실존 정치인이 등장하는 역사 드라마의 명예훼손 판단 기준에는 기본적으로 사실을 다루는 언론보도의 기준과 드라마가 갖는 장르와 표현방식의 특성이 함께 적용되고 있었다. 드라마에 나타나는 실존 정치인에 대한 허구적 묘사는 그 서술방식에 따라 그 허용 범위가 달라질 수 있으나 그 판단은 대체로 외적 개연성과 내적 개연성을 지닌 역사적 개연성 을 토대로 공익성, 진실성과 상당성을 적용함으로써 이루어지고 있었다. 특 히 드라마의 완성도를 높이기 위해 사용된 허구적 묘사도 공익성을 충족한 다고 판시하여 실존 인물을 다룬 드라마의 표현의 자유가 신장된 것으로 나 타났다. 한편 드라마 제작진들은 명예훼손 판단의 기준에 폭넓은 역사적 해 석의 수용이 필요하며 표현의 자유를 위축시키지 않기 위해 상호거증책임제 도의 도입이 필요하다는 의견을 제기하였다.
Abstract
This study tries to give solutions to make a reasonable balance between the freedom of expression and the rights of how public figures’ representations are portrayed in historical dramas. The study examines what standards the courts have applied to the fictional representation of the public figures in historical dramas and what is needed to be taken into consideration to make appropriate standards by analyzing the libel cases by politicians involved in historical dramas and by interviewing persons related with the drama production. The results show that the courts have not only applied the same standards as press reporting but also taken the features and the way of representation of drama genre into consideration. The acceptable range of fictional representation of historical figures depends on various factors, such as modes of narrative. The application scope of immunity of unlawfulness is also applied to the fictional portrayal mostly based on historical probability. It is noteworthy to note that the level of completion of the work can be applied in assessing the public interest element according to the decisions. Writers and diresun8541839ctors of historical dramas ask the courts to apply wider standards for the historical perspective. And they also ask that the burden of proof must be given to persons bringing claim in cases to increase the freedom of expression in historical dramas.
