China’s Electricity Law toward Renovation of the Electric Power Industry

Electric power industry is the basic and public industry of the social development and national economy. After the China’s reform and regulating in 1979, the electric power industry of China is developing rapidity. At the same time, the enacting of legal system related to the China’s electric power industry became a new problem which must be solved. Chinese government became to draft the China’s “Electricity Law” in 1985. The legislation process used 10 years, the first law of China’s electric power industry called “Electricity Law of the People’s Republic of China” was promulgated on April 1, 1996. This Law ended the no law existed history in China’s electric power industry. But the status of the China’s electric power industry was changed during recent 10 years by the reform of electricity constitution and rapid growth of the China’s economy. If we review the electricity law we may find some legal articles are not adapted to the recently status of the industry in China. So the law which regulate power industry must be make up for it’s weakness. This paper reviews the China’s “Electricity Law”. Firstly, the legislative system of China’s electric power industry is surveyed. Then main contents and features of the law is analyzed. At last, discussion on weakness of the law is carried out. When Korean enterprises want to enter into China’s electric power market, they must understand the weakness of the local laws. The main objective of this paper is to provide a brief idea of the law in China related to electric power industry.
