초록
이 글은 현행 전파법상의 주파수 회수․재배치와 관련하여 그 법리적 문제와 실무적 문제를 살펴보는 것을 목적으로 하였다. 그렇게 함으로써 새로운 주파수시장의 수요를 만족시키고 주파수 이용효율을 높일 수 있는 주파수 회수․재배치에 따라 발생하는 손실보상의 처리에 도움이 될 수 있도록 하였다. 이 글은 주파수 관리체계에서 중요하게 등장하고 있는 주파수 회수․재배치의 법률요건과 법률효과를 살펴보기 위하여 과연 주파수가 어떠한 법적 성질을 가지고 있는지 또 주파수 이용권이 어떠한 것인지, 그리고 주파수 회수․재배치가 가능한 경우와 손실보상의 대상과 범위를 주된 논의의 대상으로 하였다. 주파수 회수․재배치에 따른 손실보상은 정보통신진흥기금으로 이루어지는데, 이러한 방송통신위원회에 의한 손실보상 이외에 우리 전파법은 시설자등에 의한 직접보상이 가능하도록 규정하고 있다. 이러한 시설자등에 의한 직접보상은 법리적 문제를 안고 있기는 하지만 무선시설에 대한 시장가치에 따른 평가가 이루어질 수 있는 주파수 매매를 도입하는 길이 될 수 있다는 점에서 바람직하다고 할 수 있다.
Abstract
This paper has aimed at providing deeper insight into the legal theory and practices of withdrawal of frequency assignments and spectrum refarming in Korean Radiowave Act. As such it could be used as a guide of compensation by Administrations on spectrum withdrawal & refarming which is a good spectrum management tool that can be used to satisfy new market demands and increase spectrum efficiency. The main theme has been the introduction of spectrum withdrawal and refarming as a part of the overall spectrum management activities and the compensation incurred by spectrum withdrawal and refarming. In addition to the theoretical aspects of withdrawal and refarming the legal instruments of withdrawal & refarming and compensation issues caused thereof have been investigated. Refarming funds to compensate premature withdrawal has been established in Korea, but it is notable that newly adopted direct compensation to the old user by the new user is a good tool to introduce spectrum trading.
