자산유동화증권을 활용한 자본조정에 관한 연구

Since the enactment of 1999, the ABC(Asset Backed Securities) law has been utilized as means for providing funds for financial institutes and cooperates through resolving bad bonds, satisfying capital adequacy ratio and reducing debt ratio. However, given that ABS law is under weak scrutiny, banks are more likely to utilize the law for satisfying mere BIS((Bank for International Settlements) capital adequacy ratio than for improving their financial structure with enhanced liquidity. From this perspective, this research aims to analyze and prove whether domestic banks utilize the law as a tool for adjusting their capital levels by transferring bad loans to ABS in order to maintain its capital adequacy ratio. As shown in the analysis results, only weak banks are utilizing the law for adjusting their capital levels by transferring NPL (Non Performing Loans), one kind of bad loans, to ABS. This implies that banks intends to escape from regulations on capital by choosing ABS under a relatively weak scrutiny over loan loss provision for bad loans which recently comes under heightened scrutiny. The results of this research are expected to suggest a regulation direction on ABS of banks to the regulatory authority and broaden the understanding of ABS, leading to facilitating a range of relevant researches.
