중국 불법행위법 제정의 현황과 전망

초록
1978년 중국 정부가 개혁개방 노선으로 기본정책의 전환을 추진한 후 그동안 중국에서는 민사관련 법제의 제정과 정비가 매우 활발하게 추진되었다. 예컨대 민법총칙, 담보법, 계약법, 물권법 등이 제정되어 시행되고 있으며 이제 불법행위법만 정비가 된다면 민법전 제정도 조만간 성사될 것으로 기대된다. 아직 중국에는 독립된 불법행위법이 존재하지 않는다. 다만 민법총칙의 개괄적인 규정과 최고인민법원의 사법해석에 의존하고 있을 뿐이다. 이처럼 불법행위로 인한 손해배상책임에 대한 법리나 법제가 빈약함으로써 피해자의 보호에 여러 가지 어려움이 야기될 것이라는 점은 쉽게 예상할 수 있다. 중국 정부는 최근 불법행위법 제정에 착수하여 2008년 12월 23일 侵權責任法(불법행위법) 2次審議稿를 발표하였다. 또한 학계에서는 일찍부터 민법전의 독립된 한 편으로 불법행위법을 제정할 것을 주장하면서 민법전 편제 중의 한 내용으로서 불법행위법의 초안을 제시하였다. 梁慧星 敎授가 중심이 되어 기초한 중국사회과학원의 법안과 王利明 敎授가 중심이 되어 기초한 법안이 있고, 최근 중국법학회의 연구과제로서 제출된 楊立新 敎授의 초안 등을 들 수 있다. 중국의 불법행위법 초안은 총 12장 88개 조문으로 구성되어 있으며, 제1장 : 일반규정(제1조 - 제6조) 제2장 : 불법행위 책임요건과 책임내용(제7조 - 제25조) 제3장 : 책임면제와 감면(제26조 - 제30조) 제4장 : 책임주체에 관한 특별규정(제31조 - 제38조) 제5장 : 제조물책임(제39조 - 제45조) 제6장 : 자동차손해배상책임(제46조 - 제52조) 제7장 : 의료사고로 인한 손해배상책임(제53조 - 제66조) 제8장 : 환경오염으로 인한 손해배상책임(제67조 - 제71조) 제9장 : 위험책임(제72조 ; 제77조) 제10장 : 동물로 인한 손해배상책임(제78조 - 제81조) 제11장 : 공작물로 인한 손해배상책임(제82조 - 제87조) 제12장 부칙 으로 구성되어 있다. 현재 심의가 진행 중인 불법행위법 초안은 그 내용이 구체적이지 못하고 개괄적이라는 비판을 면할 수 없을 것이다. 더구나 행정법적인 성격을 띤 내용은 삭제하는 등 일련의 정비가 필요하다고 보인다. 과연 앞으로 어떠한 내용의 불법행위법이 제정될 것인지 주목해 볼 일이다. 특히 학계에서 주장되고 있는 내용들이 어느 정도 반영될 것이지도 관심의 대상이 된다.
Abstract
Chinese government have selected their national policy as reforming and opening on 1978. Since then, China promotes briskly to reform and maintain the civil legislations. For example, China reformed the general civil provision, guarantee law, contract law and reality of law areas; China is now ready to maintain the tort law area to change and reform the civil code. China still hasn't regulates the tort law up to a recent time; which means China rely only upon general civil provision and private statute interpretation. Thus, when there were illegal acts, there will be occurred several difficulties to protect the injured party, due to poorness of the legislation on the compensation. Chinese government announced the substances of the draft of the tort law on December 23rd, 2008. This essay will introduce the analysis on the draft of the chinese tort law. The draft of the chinese tort law constitutes 12 chapters with 88 articles.
