탄소배출권 관련 금융상품화를 위한 법적 과제

본 연구는 탄소배출 금융상품의 도입에 있어 제기되고 있는 법적인 과제와 해결방안을 살펴보고 향후 탄소배출 금융상품의 활성화 방안을 검토한다. 한국은 전세계에서 탄소배출이 9번째로 많은 나라이다. 국제적으로 온실가스 배출 감축 압력이 거세짐에 따라 한국도 온실가스 배출의 대폭적인 감축 노력이 필요한 상황이다. 향후 온실가스의 대폭적인 감축을 위해서는 효율적인 탄소배출권 거래시장이 형성되고 탄소배출과 관련한 다양한 금융상품의 도입을 통해 시장의 원리에 의한 배출권 감축의 효과를 거두는 법률적, 제도적인 방안이 마련되어야 한다. 그러나 온실가스 배출권의 거래와 배출권 관련 금융상품과 관련하여 다양한 법적인 이슈가 존재한다. 탄소배출권과 탄소배출권 파생상품의 법적 정의, 금융법적인 관점에서는 탄소배출권이 일반상품 또는 그 유사한 것으로 볼 것인지의 여부, 배출권 거래소와 관련하여 시장구조에 대한 법률적인 검토 등이 필요하다. 또한 탄소배출 관련 금융상품의 도입에 있어서도 탄소배출권 펀드의 법적 개념과 구조, 투자대상 자산에 대한 법적문제등이 있다. 이와 더불어 배출권 거래이 기반이 되는 감축목표 설정, 감축대상 선정 및 할당, 측정 등의 인프라 구축이 시급한 상황이다. 이와 같은 법률적ㆍ제도적인 문제를 해결함에 있어 가장 중요한 기준은 배출권 거래제도 및 배출권 관련 금융상품의 도입이 궁극적으로 국내 탄소배출을 효율적으로 감축시키고 기업부문의 피해를 최소화하며 저탄소 녹색성장을 지원하는 방향이어야 한다는 점이다.
Abstract
This study reviews the legal problems of introducing the carbon financial instruments in Korea. Global warming broadly affects individuals, companies and countries. It will be impossible to achieve economic growth while ignoring the environment. In the wake of the adoption of the Kyoto Protocol in 1997, the right to emit carbon dioxide became a new financial instrument and a new emission trading mechanism was introduced. A carbon market needs to be created to smooth out emission trading in Korea. In order to introducing the carbon market, the legal definition of carbon emission and carbon derivatives need to be established. And the trading system for the carbon emission trading should be established. It is difficult to see benefits from the carbon market without legally binding carbon reduction obligations. An enforcement capacity to check actual compliance with allocated emission quota should be in place along with proper allocation criteria. And Korea should introduce an investment fund that combines carbon finance and investment in the green industries, suitable for the domestic market conditions.
