블로그 등의 인터넷 개인미디어의 사회적 영향력이 날로 커져감에 따라 개인간 법률 분쟁을 포함해 다양한 문제들을 제도적으로 해결하기 위한 시도들이 이뤄지고 있다. 그 가운데는 현행 임시조치 또는 개정 시도로 논란을 빚은 정보통신서비스제공자의 모니터링 의무화, 사이버모욕죄 등 다양한 법률 조치들의 강화가 포함되어 있다. 본 논문은 이러한 상황에서 개인미디어 관련 현행 규제 법률의 문제점을 소통 현장 차원에서 구체적으로 파악하고 이를 현업 전문가들과의 포커스그룹 인터뷰를 통해 구체적으로 확인하여 개선 방안을 제언하는데 목적을 두고 있다. 연구결과를 보면, 첫째, 현행 규제 법률은 개인미디어 상의 갈등을 조정하는 분쟁조정기구의 비효율성을 포함해 임시조치, 저작권, 개인미디어의 상업적 활동, 청소년보호 등에 관련해 문제점을 안고 있다. 둘째, 현업 전문가들 역시 이러한 사항들의 문제점에 동의하고 있었으며, 셋째, 바람직한 개인미디어 규제 방안은 ADR과 정보통신서비스제공자 등 민간영역의 자율규제를 통해 다양한 가치가 구현될 수 있도록 하는 것이다.
Abstract
This article focuses on the efficient regulation system of internet personal media such as blogs and mini hompages, etc. As internet personal media used much impact on the various social, political issues and legal conflicts between individuals in these days, there is a hot controversy on the regulation of personal media. Therefore this article study on the efficient regulation system to protect individual rights and improve civic values of personal media. For the goal, this article analysis the controversial facts of the current regulation system and then do a focus group interview with six field professionals. The result as follows: First, the current controversial points in the regulation system are an inefficient dispute resolution system, an emergency blinding of information, commercial actions in the personal media, a copyright, a protection of children from illegal informations. Second, field professionals put great emphasis on the self regulation of personal media because of an inefficiency of the current regulation. Third, The best way to balance the various values of personal media is a self regulation system of non-governmental sphere such as ADR and ISP monitoring.
