美國에서의 메타 데이터와 辯護士倫理에 관한 論議

초록
메타 데이터에 관한 기본적인 논의조차 전무한 실정인 우리의 현실에 비해, 미국은 이미 전자적 자료에 관한 일반적인 논의를 토대로 연방규칙 개정한 바 있다. 또한 최근 메타 데이터와 관련하여 변호사윤리에 대한 논의까지 진행되는 모습은 우리의 현실을 돌아보게 한다. 미국에서 메타 데이터와 변호사윤리의 문제가 주로 증거개시절차와 관련하여 논의가 이루어지고 있어, 민사상 증거개시절차가 인정되지 않는 우리의 현실과는 별개의 것이라 생각할 수도 있다. 하지만 메타 데이터와 변호사윤리의 문제는 증거개시절차 외에서도 여전히 문제가 될 수 있고, 오히려 더 큰 문제일 수 있다는 지적은 메타 데이터로 인한 문제가 비단 미국에 국한된 이야기는 아니라는 사실을 깨닫게 한다. 또한 우리의 현실 역시 일상생활에서 생성, 사용, 저장되는 대부분의 자료가 전자화된 데이터의 형태인 점을 감안한다면, 메타 데이터로 인한 문제는 우리에게도 멀지 않은 현실임을 알 수 있다. 다만 아직 문제가 겉으로 드러나지 않았을 뿐이다. 현재 미국 역시 메타 데이터로 인한 윤리문제를 해결하기 위한 명문규정이나 법원의 통일적인 기준 또는 해석이 존재하는 것은 아니지만, 미국변호사협회와 몇몇 주의 변호사협회 윤리위원회들은 그 나름대로의 논리를 가지고 일정한 지침을 제공하고 있다. 이에 대한 고찰은 향후 우리 현실에서 메타 데이터로 인한 문제의 발생을 미연에 방지할 수 있는 논의의 초석이 될 수도 있고, 문제가 발생할 경우 해결을 위한 지침으로서의 역할을 할 수 있을 것이다. 궁극적으로는 본 연구가 메타 데이터에 대한 관심을 유발하고, 메타 데이터와 같은 전자적 자료를 효율적으로 규율할 수 있도록 전자적 자료에 관한 일반규정을 마련하는데 보탬이 되었으면 한다
Abstract
There is little discussion on metadata in the civil procedure in Korea. On the contrary recently amendments to F.R.C.P. and F.R.E took effect to address the unique problems presented by electronically stored information in U.S.A. And the recent proliferation of electronic discovery, e-filing and use of e-mail has created an ethical dilemma surrounding the disclosure and mining of metadata. So, recently there are lots of discussion on the ethical problems with metadata in U.S.A. It is a scene unfamiliar to us, because there is no discovery system in the civil procedure in Korea. However, ethical problems with metadata bears the most weight outside of formal discovery and in transactional practices. So, it could be our problems. Although there is no specific rule to deal with these problems, there is ABA Model Rules of Professional Conduct and some states have set the trend by imposing an ethical duty on the attorney to appropriately manage metadata in U.S.A. Reviewing their opinions on metadata would lay the foundation for solving problems with metadata in the civil procedure in Korea.
