이 글은 로마법상 사용취득의 권원 중에서 일반적으로 잘 알려져 있지 않은 pro suo와 그 반대개념이라고 할 수 있는 pro possessore를 살핀 것이다. 권원은 소유권 취득의 유형에 따라서 승계취득적인 권원과 원시취득적인 권원이 두루 인정되었다. 일반적으로 잘 알려진 권원들은 거개가 법률행위에 기초한 승계취득적인 것이었던 반면에, 고찰의 주된 대상이었던 pro suo는 특별한 권원의 표시로서는 전자를 제외한 일체의(특별히 명명되지 않은) 권원을 포괄하는 것이었지만, 다른 건원이 인정될 때 그 상황을 부연하여 확인하는 기능의 일반적인 어법도 알려져 있었다. 법률가들 중에서는 유독 폼포니우스의 경우 아직 개념적인 확실성이 분명하지 않은 듯 보이기도 하는데, 어쩌면 전승되어 현존하는 사료의 양적, 질적 한계 탓인지도 모른다. 그밖에 바실리카 법전의 전승은 구체적인 권원의 표시 부분들이 그리스어로의 번역에서 제외되는 경우가 많은 것으로 드러나는데, 이는 비잔틴법에 이르면 당시 법의 현상을 반영하면서 대체로 취득시효의 권원에 큰 관심이 없었음을 보여준다. Pro possessore는 사용취득의 자격이 없는 모든 점유자에게 사용되었다. 그밖에는 로마법 연구자들의 로마법 이해방식에 촉발되어 로마법학의 법학으로서의 독특성을 몇몇 측면에서 부각시키는 작업도 얼마간 수행하였다.
Abstract
This paper deals with the titles (tituli) of usucapio in Roman law, especially pro suo and pro possessore, which have been until now no object of concern among the Korean scholars. Title means a legally recognized method (iusta causa) of transferring or otherwise acquiring ownership. The derivative type, covering any juristic act apt to transfer the ownership, includes purchase (pro emptore), gift (pro donato), dowry (pro dote), legacy (pro legato), solution of debt (pro soluto), etc. The type for original acquisition includes occupation, specification, discovery of treasure-trove, etc. Pro suo-title was used in two ways. Once it endorses the situation already confirmed by other title (pro suo generalis). Pro suo-title qua specialis is a comprehensive term for all other cases of titles without own name, especially including the type for original acquisition. The cases of the so-called putative title, of which we must define precisely what it means exactly, occur only when the pro suo-title comes in question. Among the Roman jurists, only Pomponius seems to be precarious of the pro suo-title, but for a reasonable judgment we perhaps have no firm footing from a reliable source both in quantity and in quality. The Basilica text shows that the Byzantine law had, as a matter of law, in principle no more genuine interest in the title issue. Pro possessore stands for all possessors who are without legitimacy to usucapere. For the rest, I tried to show the characteristical traits of the Roman jurisprudence in the classical and the preclassical period which are typically misunderstood even by the contemporary Roman law scholars. It is not in the context of a case law that the Roman jurists developed their doctrine of pro suo usucapio, but in real consequence of their conscious legal theories, based on the Greek philosophy, but creatively refined to a great extent for the practice in order to meet respectively the challenges of their ages. Their articulation of legal science was such an enormous success that it spread over Europe and reached us, too.
