방송통신위원회 심판관리제도의 합리적 개선방안 연구 - 효율성제고를 중심으로 -

초록
‘심판’의 의미는 제1차적 행정절차로서 방통위가 행하는 심결을 의미한다. 따라서 심판관리제도라 함은 방송통신위원회가 행하는 심결이 이루어지기까지의 행정절차에 관한 제도를 의미한다. 본 연구에서는 방송통신위원회가 담당하고 있는 업무별, 영역별 특성을 고려하여, 公正性, 專門性, 效率性을 분석도구로 활용하여 심판관리제도의 합리적 운영방안에 대한 개선방안을 제시하면서, 이 중 효율성 제고 측면에 초점을 맞추었다. 또한 방송통신위원회의 심결절차에 있어서의 적법절차 구현도 아울러 다루었다. 이를 위해 여러 가지 중요 쟁점을 비교법적 관점에서 국내외 사례를 비교 검토하였고, 구체적인 개선방안에 대해 다루었다. 그 중요 쟁점으로는, 내용적측면과 절차적 측면으로 나눌 수 있는데, 내용적 측면으로는 중복규제문제, 융합환경에 적합한 규제체계 정비, 행정사무와 심판사무의 구분, 동의명령제도, 행정법판사 제도 등이 있고, 절차적 측면으로는 회의운영에 관한 규칙 개선, 회의공개범위 문제, 사건처리절차 규칙, 사전준비절차 개선방안, 주심위원제도 등이 있다. 각 쟁점별로 국내 유사기관과의 비교분석을 통해 개선방안과 시사점을 제시하였다.
Abstract
The “judgment” in this research means the deliberations and resolve by Korea Communications Commission and it means also the first administrative procedure of KCC. Therefore, “judgment management system” deals with the administrative procedure of judgment making and deliberations of KCC. This study suggest the improvement way of judgment management system and better implementation of due process in deliberation based on the analyzation by efficiency. For this purpose, I study the similar Judgment Management Systems of various institutes such as Fair Trade Commission, the Court, the Administrative Judgment Commission, and many other foreign institutes based on the analyzation of administrative theory. As a conclusion, I suggest improvement ways such as introduction of expert committee which is used by many state institutes, general counsel of Fair Trade Commission, better improvement of preliminary proceedings and the chief commissioner system.
