초록
2009년 현재 한국에 거주 목적으로 정주하는 외국인이 전 국민의 2%를 차지하게 되었으며, 결혼에 의한 이민 건수도 대폭 증가하면서 한국은 다문화사회가 되었다고 한다. 그러나 정주 외국인을 포함하여 외국인과 혼인한 가정(다문화가족)이 대폭 증가하였음에도 불구하고 입법적․제도적 장치의 미흡으로 인하여 외국인 및 다문화가족이 한국사회에 정주하는 과정에 많은 갈등을 겪고 있다. 특히 이들의 자녀들의 경우는 부모가 외국인이거나 부․모 중 1방이 외국출신이라는 이유로 인하여 학교교육에서 문제를 겪고 있는 사례가 학교현장에서 다수 보고되고 있다. 또한 체류 자격변경 외국인(이른바 불법체류자)의 자녀들의 경우 헌법이 보장하는 교육권을 사실상 향유하지 못하고 있다. 한국 헌법의 문화국가원리, 교육을 받을 권리 등을 기초하여 볼 때 외국인의 자녀, 특히 체류자격 변동 외국인의 자녀에게도 교육권이 실질적으로 보장이 되어야 한다. 다문화사회의 의미, 다문화사회와 관련한 헌법적 입장 및 근거, 다문화가족 자녀들의 교육권에 대한 헌법적 입장을 기초로 현행 외국인 및 다문화가족 법제에 대한 문제점과 대안을 헌법과 입법정책학적 입장에서 논의를 하여야 한다.
Abstract
Recently in Korea comparing with the exponential growth of the number of foreign people, there are not enough legislative trials and appropriate measures to support them: violations of human rights for migrant workers, the growth of multi-cultural family and their children, crimes related foreign people and so on, and Korean legislative system is in sufficient to solve these problems related foreign people. There are some legislation for foreigners in Korea such as the Immigration Control Law, Act on the Treatment of Foreigners in Korea, and Enforcement Decree of the Act on Foreign Workers' Employment, etc. and actually these laws are being improved or enacted newly. However, most legislators consider foreign people not as companions live together but as persons who are controlled for our societies. Foreign people are only ‘alien’ in the legal status but they are only human being in Korea just like members of nation. Legislators should judge and decide to grant concrete rights to foreign people and to recognize their equal legal status. But it is impossible foreign people to be unified with Korean as far as Korean legislators think there is fundamental differences between them. The improvement of legislations related foreign people has an effect on initially foreigners but in the long run all the people who live in the same nation.
