교육복지 분석 준거틀 구성과 교육복지법에의 적용

본 연구는 교육복지 분석틀을 구성하고 구성된 분석틀로서 국회에 계류중인 ‘교육복지법’을 분석하고자 하는 것이다. 교육복지 분석준거틀은 크게 세 가지 분석틀을 원용하였다. 우선 교육복지의 이념이나 개념에 대한 학자들의 주장들을 정리한 교육복지 구성틀이다. 거기에 교육복지가 사회복지와 교육의 결합이기 때문에 사회복지정책 분석틀과 교육정책의 분석틀을 사용하였다. 그리하여 교육복지 분석준거틀을 구성하는 요소들로, 평등성, 통합성, 일관성, 협력성, 책임성, 전문성, 개별성, 참여성, 효율성, 접근성, 포괄성, 공공성 등 12항목이 선정되었다. 이렇게 구성된 교육복지 분석준거틀을 국회에 계류 중인 5장 27조의 ‘교육복지법’에 적용하였다. 그 결과 상당히 많은 부분에서 교육복지법으로서의 흠결이 발견되었다. 특히 교육을 수업이나 학업성취와 등치시킴으로서 교육을 지나치게 협소하게 개념정의한 문제와 교육복지 잔달체계에서 전문가 개입을 명문화하지 않는 등의 흠결이 발견되었다. 법률 성안 과정에서 이루어지는 국회 토론에서 이에 대한 대책이 마련되어야 할 것이며, 이후 시행령, 시행규칙의 제정에서도 상당부분 보완이 이루어져야 할 것이다.
Abstract
This study is to analyse education welfare law, which is to be handled in the National Assembly. Three analysis criteria are mainly used to analyse education welfare analysis framework. The first analysis criterion is the scholars' definition about the concept or philosophy of education welfare. The analysis criteria of social welfare policy and that of education policy are also used because education welfare is a combination of social welfare and education. Thus, 12 factors consisting of education welfare are selected: equality, integrity, consistency, cooperation, accountability, specialty, individuality, participation, effectiveness, accessibility, comprehensiveness, public interest. The analysis framework of education welfare is applied to education welfare law, which is now waiting to be processed in the National Assembly. It is found out that quite many parts of it proved to be inappropriate as an education welfare law. Especially, it lacks professional delivery system and defines education in a quite narrow way, while putting too much emphasis on academic achievements or teaching itself. Therefore, following measures should be prepared for this matter during this coming National Assembly session. Also, substantial supplementation needs to be considered regarding to 'enforcement ordinance and enforcement provision' later on.
