변호사보수 분배의 금지와 관련된 문제점

초록
현대사회와 같이 복잡다기하고 전문화된 법률관계 등에 대하여 이를 변호사만이 독점하여 해결할 것을 기대할 수는 없다. 또한 변호사 스스로도 의뢰인의 승소를 위해서 법률관계 여부를 떠나 특정분야의 전문지식을 필요로 하는 경우가 많이 발생하고 있다. 이러한 경우 변호사가 그 전문가로부터 전문지식을 제공받은 후 의뢰인으로부터 받은 보수 중 일부를 전문가에게 지급할 수 있는지 여부 및 비변호사인 전문가가 변호사로부터 그 보수 중 일부를 제공받을 수 있는지 여부가 바로 변호사법 제34조 제5항과 관련된 문제이다. 변호사 보수분배의 금지를 선언한 위 규정에 대하여는 동 조항만을 대상으로 해석할 것이 아니라 같은 조의 제1항에서 제4항까지의 규정취지를 종합하여 실질적으로 해석함이 타당할 것이다. 즉, 비변호사가 법률사무에 관하여 변호사와 동업하든가 또는 비변호사가 변호사를 고용하는 형태로써 변호사의 보수를 분배받는 것과 같이 사실상 변호사의 독점업무인 법률사무에 직. 간접적으로 개입하는 방법으로 변호사의 직무상 독립성을 침해할 우려가 있는 경우에 한하여 이를 금지할 뿐이라고 해석을 함이 상당하다고 사료된다.
Abstract
It cannot be expected that the lawyers can make solution of the complicated and specialized legal problems occurring in the modern society without assistance of the experts in other areas. In a lot cases, lawyers need assistance of expertise in the special areas to win the lawsuit for their clients. In these cases, the problem is whether the lawyer who earned assistance from the specialists in other areas can pay to the specialists a portion of the legal fee earned from his clients, which is the problem related to clause 34, subclause 5 of the Attorneys-at-Law Act. The subclause above which prohibits the sharing of the attorney’s fee with the specialists in other areas cannot be interpreted on its own, but should be interpreted collectively together with the subclause 1 upto subclause 4. In essence, the subclause 5 should be interpreted to prohibit the situation only when the lawyer’s official independence can be materially infringed in the way that non-lawyers intervene in the practice of law directly or indirectly which is exclusive area of the lawyers. For instance, having partnership for legal services between lawyer and non-lawyer, or sharing of lawyer’s fee with non-lawyers by hiring lawyers should be prohibited under the subclause 5.
