The practical implementation of the provisions of Article 76 of the UN Convention on the Law of the Sea is the responsibility of all coastal States that intend to have national jurisdiction over the continental shelf beyond 200 NM. In order to implement the responsibility, the Eleventh Meeting of States Parties to the Convention noted that the date of commencement of the ten-year period for making submissions to the CLCS would be on May 13, 1999. In addition, considering the problems encountered by States Parties, in particular developing countries, the Eleventh Meeting of States Parties also decided that the general issue of the ability of States, particularly developing States, to fulfill the requirements of the Convention be kept under review. However, due to lack of financial and technical resources and other relevant contents, many developing countries face particular challenges to fulfill these requirements. Therefore, on 20 June 2008, the Eighteenth States Parties Meeting decided that the ten-year time period might be satisfied by submitting preliminary information indicative of the outer limits of the continental shelf beyond 200 M and a description of the status of preparation and intended date of making a submission. This paper examines and analyzes major cases submitted to the CLCS as preliminary informations and then suggests desirable ways to resolve a boundary delimitation between adjacent or opposite states having the outer limits of the continental shelf beyond 200 M.
