전자상거래관련 현행 처벌법규의 해석과 문제점

초록
인터넷과 전자상거래가 오늘날 경제생활에서 차지하는 비중은 실로 막중하지만, 이는 짧은 기간 내에 급격히 확대된 현상이기 때문에 그에 따른 부작용인 범죄문제에 대한 대처방안은 그만큼 쉽게 마련하기 어려운 숙제를 법학자들에게 안겨주었다. 우리나라에서는 1995년에 형법전에 중요한 컴퓨터범죄를 유형화하여 그에 대한 처벌규정을 처음으로 마련하였다. 그 입법도 이제 10여년이 지나면서 다시 새로운 범죄유형들이 등장하여 각종 특별법에 관련처벌규정을 보완입법하고 있다. 기본 형법전과 각종 특별법에 분산 규정되어 있는 이러한 입법적 복잡성은 관련규정에 관한 해석과 적용에 있어서도 적지 않은 문제점을 야기하고 있다. 또한 우리 형법학계에서는 실정법규정과 전자상거래 현실 간의 간격과 모순을 줄이기 위한 노력을 기울이고 있으며, 이런 과정에서 인터넷형법학이라는 새로운 학문영역을 개척해나가고 있다. 본고의 내용은 그간의 학계와 실무계의 일련의 노력의 결실을 소개하는 것이라고 할 수 있다. 정보전달의 광역성과 용이성이라는 특성으로 인하여 이를 이용한 경제범죄는 전통적 범죄유형과는 비교하기 어려운 정도로 그 피해의 범위가 넓고 규모에 있어서도 크다. 이러한 문제점을 해결하기 위해서 정부나 기업의 기술적-제도적 통제장치가 차츰 정비되어가고 있는 실정이다. 본고에서는 우선 인터넷과 전자상거래의 활성화에 따라 야기된 범죄문제의 현실상황을 언급한 후, 본론으로 들어가 우리 형법상 컴퓨터범죄관련규정을 학계와 실무계의 연구를 토대로 하여 해석하고 그 문제점을 검토하는 순서로 전개되고 있다.
Abstract
Business through electronic means is not a completely new phenomenon; banks in particular have been engaged in electronic transmission of funds, whether within their national boundaries or internationally, for some years. However, recently, the entire business community has become involved in e-Commerce, and its ramifications can now be more clearly perceived than ever before; in fact, they are not only far reaching but some are also disturbing. E-Commerce has its advantages and disadvantages; whereas its advantages become obvious in carrying out business and transactions, the business community needs to take precautionary measures against its misuse and abuse in order to ensure that the disadvantages of e-Commerce do not outweigh its advantages. In the measures have the punishment regulations very important role. In this paper are the interpretations of regulations in Korean Criminal Code concerned with e-Commerce & computer crimes and the problems raising in the work handled.
