산재근로자의 실제 손해액을 기준으로 한 산재보험과 국민연금의 중복급여체계 평가

산업재해를 입은 근로자는 산업재해보상보험법상 지급되는 보상급여와 함께 국민연금법상의 유족연금 (또는 장애연금)의 1/2 상당액을 부가적으로 지급받을 수 있다. 그러나 산재로 인해 계속 근무하지 못하게 되는 경우에는 국민연금법상의 노령연금 부분에 있어서는 오히려 손해를 입을 수 있다. 본 연구에서는 산업재해에 대한 보상에 있어 대부분을 차지하는 산재보험이 사회구성원의 적절한 소득보장 등을 근간으로 삼고 있는 사회보험의 하나로서 자리 잡고 있지만 기본적으로 재해보상적 성격을 가지고 있다는 사실을 주요 관점으로 하여 산재와 국민연금에서 볼 수 있는 중복급여체계에 대한 경제적 분석을 시도하였다. 구체적으로 먼저 피재근로자의 실제 손해액을 상정한 다음 이를 산재보험법상의 급여와 국민연금법상의 급여지급 효과를 모두 고려한 실제적인 보상수준과 상호 비교분석하였다. 분석결과 피재근로자가 국민연금법상 지급받게 되는 급여의 순현금흐름은 피재근로자의 총손해액과 보상액의 크기에 그다지 영향을 미치지 않는 것으로 확인되었다. 뿐만 아니라 현행 산재보험의 보상급여체계 하에서는 국민연금법상 유족연금 또는 장애연금의 지급을 전액 정지시켜도 피재근로자에게는 실제 손해액 측면에서 봤을 때 과소보상의 문제가 발생하지 않는 것으로 확인되었다. 재해보상이라는 측면에서 도출된 이러한 현실적 결과는 향후 산재보상보험법과 국민연금법상의 보상급여체계의 조정 논의시 중요한 참고자료로 사용될 수 있을 것이다.
Abstract
Injured employees or survivors are entitled to the benefits provided by National Pension as well as the benefits in Workers' Compensation. In the meantime, they may lose some portion of the old age benefit in National Pension, because they stay shorter in the system as a result of the injury or death. In this paper, considering indemnity principle related to Workers' Compensation, we analysed what are the actual effects of the National Pension considering present value of the old age pension which the employees may have received if they did not suffer injury or death and also, the benefits from the Workers' Compensation. We found that actual cash flow from the National Pension does not have any noticeable effect on the total amount of loss incurred by the employees. That is, as long as the benefits of the current Workers' Compensation continue, the employees will not suffer from insufficient compensation problem even if the benefits from the National Pension do not apply any longer and stop.
