독일 공공부문 직원협의회와 노동조합의 구조와 기능: 종사원노동조합의 단체협약, 공무원단체의 공무원정책 참여, 그리고 직원협의회의 근무협정을 중심으로

In this paper I want to make clear the collective rights of the trade unions, the civil servant associations, and the staff councils in German public sector. The public personnel labor management in Germany combines the civil servant policy with the collective bargaining policy, because the attendants in German public sector consist of civil servants administrated by the ‘civil service law' and employees (salaried and wage-earning) managed through the ‘labor laws'. The German public personnel labor management is a democratic model that institutionalizes the participations of the trade unions, the civil servant associations, and the staff councils in formulation of the tariff policy, the civil servant policy, and the task agreements within agencies. The collective agreement based on a autonomous rule system functions as a good instrument for administrative reforms. And it is also useful that the trade unions concentrate their efforts on the collective bargaining, and the staff councils take care of the issues within agencies.
