정치적 표현의 자유와 표현내용에 근거한 제한 －내용 중립적 제한과 내용에 근거한 제한을 중심으로－

표현의 자유의 대한 제한은 그것이 표현의 내용인가 아니면 그 밖에 표현의 방법 등에 대한 제한인가에 따라 그 정도를 달리할 수 있다는 것이 미국이나 우리의 판례와 학계의 일반적인 견해이다. 내용 중립적 제한은 표현된 내용과는 관계없이 표현을 제한하는 경우를 말한다. 전달하고자 하는 메시지의 의사표현적인 영향이나 효과 및 그 내용과는 관계없이 표현을 제한하는 경우를 말한다. 내용에 근거한 제한은 표현의 내용에 근거하여 제한하는 경우를 말한다. 내용에 근거한 제한은 표현의 내용 중에서 일정한 주제 등을 제한하는 경우도 있고, 일정한 관점이나 관념과는 무관한 관점 중립적 제한이나 일정한 관점에 근거하여 제한하는 경우 등이 있을 수 있다. 표현의 자유에 대한 사법심사는 그러한 표현을 제한하는 유형에 따라 심사기준을 달리해야 한다. 표현의 내용에 근거하여 제한하는가 아니면 표현의 내용이나 관점과는 무관하게 제한하는가에 따라 달라질 수 있는 것이다. 국가가 개인의 표현행위를 규제하는 경우, 표현내용에 대한 규제는 원칙적으로 중대한 공익의 실현을 위하여 불가피한 경우에 한하여 엄격한 요건 하에서 허용되는 반면, 표현내용과 무관하게 표현의 방법을 규제하는 것은 합리적인 공익상의 이유로 폭넓은 제한이 가능하다는 것 이 우리 헌법재판소 판례의 태도이다. 정치적 표현은 그 성격상 일정한 관념이나 이념적인 요소를 포함하고 있으므로 그것을 제한하게 되는 경우 대체로 내용이나 관점에 근거한 제한이 될 가능성이 크다. 정치적 표현의 자유에 대한 제한의 합헌성을 심사하는 과정도 표현의 자유에 대한 제한유형에 따라 심사기준을 달리해야 한다는 점은 동일하다. 표현의 내용에 대한 제한이 이루어지는 경우에는 엄격한 심사를 하여야 하며, 그것이 관점에 근거한 제한일 경우에는 입법자의 입법형성권은 더욱 축소될 수 밖에 없으며, 심사의 강도는 더욱 강해진다고 보아야 한다. 특히 UCC에서 자신의 정치적 표현을 게시하지 못하도록 하는 것은 특정인의 정치적 관점이나 견해, 생각, 사상 등을 제약하는 것이다. 헌법재판소도 UCC가 관념이나 의사전달 매체라는 점을 인정하고 있다. 개인의 관점에 근거하여 표현의 자유를 제약하는 것은 강한 위헌성이 추정되므로 이러한 제한의 합헌성 심사과정에는 매우 신중한 접근이 필요하다.
Abstract
This Note divides these types of regulations in three categories. Content-neutral restrictions, Content-based restrictions, Viewpoint-based restriction. Content-neutral restrictions limit expression without regard to the content or communicative impact of the message conveyed. Contentbased restrictions limit communication because of the message it conveys. Viewpoint-based restriction limit speech based upon the specific idea or opinion that is being expressed. Viewpoint-based restriction are a subcategory of content-based restrictions. Content-neutral restriction should require intermediate scrutiny or rational basis standard(deferential review), on the other hand content-based restriction and viewpoint-based restriction on speech receive heightened scrutiny because such restriction pose a danger censoring idea and opinions. Contentbased restriction and viewpoint-based restriction would survive strict scrutiny only if it were narrowly tailored to serve a compelling state interest. Political speech is interactive communication concerning political change. Thus, any expression involving public affairs or the qualification of candidates is deemed core political speech and worthy of heightened judicial protection. Restriction of political speech on UCC(User-Created Contents) could be a viewpoint-based restriction, thus it should be heightened scrutiny, because viewpoint-based restrictions are the worst the kind of government restriction on speech.
