이 글은 2009년 북한 헌법 개정의 주요내용 및 특징 분석을 통하여 헌법 개정이 가지는 정치적 의미를 탐구하는데 그 목적을 두고 있으며, 나아가 향후 전개될 북한의 정책변화에 대한 전망을 검토하고 있다. 북한의 2009년 헌법은 1948년 「인민민주의 헌법」 채택 이후 9차 개헌이며 1972년 「사회주의 헌법」에 대한 3차 개정이다. 그리고 1998년 헌법 개정 이후 11년 만에 이루어진 것으로서 그동안의 북한의 대내외 변화를 담고 있다. 2009년 북한헌법은 국방위원장의 국가 최고영도자로 명문화, 국방위원회의 위상 및 권한 강화, 선군사상의 통치이데올로기 승격, 공산주의 삭제, 인권존중과 보호 조항 신설 등을 주요내용으로 하고 있다. 나아가 이번 헌법 개정의 정치적 의미로는 군사국가의 제도화, 김정일 일인지배체제의 제도화, 후계체제 구축을 위한 국가체계 정비를 들 수 있다. 북한은 헌법 개정을 통해 국방위원장을 중심으로 하는 김정일 시대의 국가체계를 완성함으로서 향후 후계체제의 안정적 승계를 위한 기반을 마련하였다고 볼 수 있다. 북한은 향후 제7차 당대회의 개최와 함께 조선노동당의 정비에 나설 것으로 보인다. 2012년으로 예상되는 제7차 당대회는 그동안 변화된 당조직들의 기능과 임무를 반영하여 당규약 개정을 시도할 가능성이 높다.
Abstract
North Korea had revised its Constitution during the first session of the 12th Supreme People’s Assembly on April 9, 2009. The newly revised Constitution modifies the existing constitution of seven chapters and 166 articles that was put in place September 1998 into a new constitution consisting of seven chapters and 172 articles. This article analyzes the meaning and characters of North Korea's new revised constitution, furthermore will predict the future of North Korea. The contents of the newly revised constitution includes strengthening the position and authority of the chairman of the National Defense Commission(NDC), power concentration in the NDC, taking Songun Ideology(Military-first Ideology) and Juche Ideology as the leadership guideline of activities, emphasis on socialism over communism, adding to phrase of the human rights for the first time. The newly revised constitution provides the constitutional and systematic groundwork for a military state and Kim Jong-Il’s autocratic dominance, furthermore establishes political system for post-Kim Jong-Il’s era. As a consequence, North Korea seems to want to remain a military state based on Songun politics(Military-first politics) and Songun Ideology. Probably significant policy change in North Korea will be made after 2012, a period when Pyongyang says it will become Kangsong Daekook(Strong and Prosperous State).
