범죄집단구성죄의 개정방향 :국제연합 국제조직범죄 방지협약과 관련하여

Transnational organized criminal groups are cancers, which are considered as one of the major threats to the entire human society, being detrimental to the social, economic, political and cultural development of societies worldwide. ‘FATF Mutual Evaluation Repot (KOREA, 2009.6.)’ make a comment about this topic that Korea does not have structured organized criminal Groups. However Korea might be attractive to the above mentioned groups wishing to make money. Today, the international community build up an united front to combat against transnational organized criminal groups. Korea has joined to the front by 2000. Recently Korea is fully furnished with the legal system and the related institutional measures, in accordance with global standards. In this paper I take a general outlook on the legal regulation to organized criminal groups in Korea, especially to criminalisation of participation in an organized criminal group. After this, I find that the statutes related with the criminalisation are fragmentary in one's own way, and not systematic in general. As the conclusion I present the ideas for the reform of the statutes, to be consistent with Palermo Convention(United Nations Convention against Transnational Organized Crime, 2000).
