교정에 있어 회복적 사법의 적용 실태와 발전 방향

초록
교정당국은 형집행단계의 목적을 제대로 달성하기 위해서 최근 선진국의 사례를 분석하여 회복적 사법(Restorative Justice) 이념을 접목한 프로그램들을 시행하고 있다. 회복적 사법(혹은 회복적 정의) 이론은 형벌집행에 대한 국가와 범죄인의 관계를 새롭게 정립하고 범죄로 인한 피해의 회복에 중점을 두는 형사사법 이론이다. 실제 시행되고 있는 회복적 교정프로그램은 가해자ㆍ피해자 화해 프로그램과 가족관계 회복 프로그램, 그리고 지역사회와의 관계 회복 프로그램 등이 있다. 가해자ㆍ피해자 화해 프로그램으로는 서울 지방교정청의 ‘피해자에게 사죄편지 보내기’ 프로그램이 2007년부터 단계적으로 시행되고 있다. 가족관계 회복 프로그램으로는 가족만남의 날, 귀휴제도, 가족사랑캠프 등이 시행되어 나름의 성과를 거두고 있다. 또한 지역사회와의 관계 회복을 위하여 지역사회 봉사활동 프로그램을 강화해 나가고 있다. 외국의 경우를 살펴보면, 싱가포르의 옐로우 리본 프로젝트가 있다. 옐로우 리본 프로젝트는 출소자의 사회재통합과 사회복귀를 주요 내용으로 하는 것인데, 2006년 6월 옐로우 리본 펀드를 조성하여 각종 지원비용에 사용하기도 하였다. 미국에서는 2008년 4월 ‘제2의 기회법(The Second Chance Act)’을 제정하였고, 배정된 예산을 범죄자의 사회복귀지원과 관련 연구ㆍ조사 등에 사용하도록 하였다. 우리나라에서 현재 시행하고 있는 회복적 교정프로그램은 범죄자의 성공적인 사회복귀를 돕는 등 나름의 성과를 거두고 있다. 이에 대한 이론적 근거인 회복적 사법 이념을 더욱 발전시키기 위해서는 학계 등 전문가들의 관심과 조언이 필요하다.
Abstract
In order to properly accomplish the purpose of level of penalty execution, Correction Authorities analyzed up-to-date case of developed countries and is now operating the new programs, combined with Restorative Justice ideology. The ideology is a kind of criminal justice ideology, which put great emphasis not only on establishment of the new relationship between authorities and offenders in execution of penalty, but also on recovery from criminal injury. Victim-Offender Mediation Program, Family Relationships Restoration Program and Local Community Relationships Program are the Restorative Correction Program in operation. As Victim-Offender Mediation Program, sending a letter of apology to victim is gradually implemented at Seoul Regional Correction Headquarter from 2007. Family Relationships Restoration Program; like Family Meeting Day, the Leave System and Family Love Camp, is being implemented and has achieved its own results. Moreover, local community volunteer activities are intensified for restoration relationship with local community. In the case of Singapore, there is a project called Yellow Ribbon Project. The project is mainly for social reintegration and rehabilitation of prisoners. In June 2006, the Yellow Ribbon Fund was raised and was used for varieties of support costs. In April 2008, The Second Chance Act was legislated in the state and its allocated budget was decided to be used for successful rehabilitation of prisoners and related research and survey. The Restorative Correction Program, being implemented in Korea, is achieving its own results such as contributing rehabilitation of prisoners. Experts’ concern and advice is indispensable to develop the ideological basis of the program, Restorative Justice.
