경제위기와 비정규직의 노동권
Economic Crisis and Labor Rights of Non-regular Workers

이 논문에서는 경제활동인구 부가조사자료를 활용하여 최근의 경제위기 상황하에서 비정규직의 고용양 변동과 노동권 현황을 분석하고 있다. 분석결과에 따르면, 2007년~2009년의 기간에 비정규직의 일자리가 지속적으로 줄어들었고, 그 고용의 질이 전반적으로 악화되고 있음을 확인케 된다. 이 기간에 임금노동의 일자리 성장세가 둔화되는 가운데 정규직 일자리가 늘어나고 비정규직 일자리가 감소하는 추세를 보이고, 특히 기간제 고용이 2008년 중반이후 증가세를 보이는 점이 특기할 만하다. 비정규직의 노동권, 또는 고용의 질에 있어서는 정규직 대비 임금불평등과 여타 고용조건의 격차가 확대되고 있으며, 이들의 사회적 보호(social protection)는 그리 개선되지 않은 채 여전히 절대다수가 사각지대에 놓여있는 실정이다. 이처럼, 지난 2년 동안 비정규직의 일자리 축소와 고용 질 악화에 대해 영향 미칠 중요한 배경요인으로는 2008년 하반기에 발발한 경제위기를 비롯하여 이명박정부의 출범과 친기업적인 노동유연화정책 추진, 그리고 2007년 7월부터 시행된 비정규직 보호법의 규제효과 등을 손꼽을 수 있다.
Abstract
This study examines the changing trends in non-regular workforce and the state of their labor rights under the recent economic crisis, by using the Economically Active Population - Supplementary Survey data. Between 2007 and 2009, non-regular jobs continue to decline, while their quality has deteriorated substantially. In this period, when the growing trend of wage labor force has slowed down, regular jobs have increased, whereas non-regular jobs have decreased. It is remarkable that fixed-term jobs have increased since the mid of 2008. Labor rights of non-regular workers, or the quality of their employment have worsened, as evinced the growing inequity of wages and employment conditions between them and regular workers. Moreover, a majority of non- regular workers remain excluded from social protection. The reduction of non-regular workers and the deterioration of their employment quality are explained by the economic crisis, taking place in late 2008, ‘business-friendly' labor market deregulation policy pursued by Lee Myung-Bak Government, and regulatory effect of the non-regular employment protection legislation.
