서해북방한계선(NLL)에 대한 남북한 주장의 국제법적 비교 분석

본 연구의 목적은 휴전체제 하의 최대의 정치․군사적 쟁점이자 한반도 평화 정착의 커다란 장애물인 서해북방한계선(The Northern Limit Line: NLL)에 관련된 남북한의 주장을 “1차(원본) 자료를 통하여” 통시적으로 비교․분석하는데 있다. NLL에 대한 연구는 국제법과 정치학(남북한 관계) 연구자들을 통해서 꾸준히 이루어졌다. 그러나 NLL과 관련된 대부분의 연구는 문제의 한쪽 당사자인 북한측 주장을 객관적으로 기술하고 있지 않다. 그간의 연구에서 제시된 북측의 주장은 거의 모두 남측의 정부, 군당국 혹은 산하 연구기관에서 발췌 또는 요약한 내용을 재인용하고 있다. 따라서 연구의 엄밀성이나 과학성이란 측면에서 심각한 문제를 야기할 수 있다. 더욱이 NLL 주변에서 문제가 발생될 때마다 개별 문제의 해결을 위한 법적, 정책적 방안 제시에만 연구가 초점을 맞추다보니 NLL 문제가 가지는 전체적 흐름을 간과하는 오류를 범하고 있다. 따라서 본 연구는 기존 연구가 가진 이러한 한계를 극복하고자 북한에서 발행한 1차 자료(로동신문, 조선중앙년감, 김일성대학력사법학, 군사정전위 회의록 등)를 중심으로 NLL에 관련된 북한의 주장을 객관적이며 통시적으로 정리하고 이를 남한 측 주장과 비교하고자 한다. 본 연구는 NLL과 관련된 남북한의 주장을 휴전 이후 최근까지 몇 개의 시기와 사건에 따라서 구분하여 서술하고자 한다. 첫 번째 항목은 1953년 8월 30일에 있었던 UN군 사령부의 NLL 설정과 이에 대한 북측의 반응 여부 및 1972년까지의 북한 측 주장이다. 두 번째 항목은 1973년 말에 발생한 소위 “서해 5도 사건”에 관련된 남북한 간의 주장에 대한 비교이다. 세 번째 항목은 1993년에 있었던 남북기본합의서 부속합의 협의 시 남북한 간의 주장이다. 네 번째 항목에서는 1999년 제1차 연평해전 이후 북측의 주장한 새로운 서해해상경계선안 과 서해해상군사분계선에 대한 분석을 시도할 예정이다. 다섯 번째 항목은 2000년 3월 23일 북한 측에 의하여 발표된 서해5도 통항 질서의 내용과 2002년 6월 발생한 제2차 연평해전 이후 북한의 입장이다. 여섯 번째 항목은 2006년 3월 남북한 장성급 군사회담에서 북한에 의하여 제기된 서해해상군사분계선 획정 문제와 2007년 남측에서 논의된 서해평화협력지대를 검토하고자 한다. 마지막 항목은 2009년 남측의 PSI 전면 참여 선언과 NLL 문제의 관련성을 논의하고자 한다.
Abstract
The primary purpose of writing this paper is to compare and analyze the positions on the Northern Limit Line(NLL) between North and South Korea from a historical viewpoint. This research will be carried out with primary sources. The past researches concerning the NLL do not fully describe the North Korea's position as it is. Most of them invoked just secondary sources developed by the South Korean government or its research institutions. This paper, however, will examine all the process of the NLL by reviewing the primary sources coming from North Korea including Rodong Shinmun, the Chosun Central Yearbook or other materials. This paper will be divided into several parts following the crucial historical incidents along the NLL. The first part will review the period between 1953 and 1972. The second part will deal with the so-called Five-Island Incident of 1973. The third part will tackle the dispute of interpretation between the two Koreas with the provisions of the NLL laid down at the Basic Agreement and its additional protocol of 1993. The fourth part will check the 1999 naval clash along the NLL and the Yellow Sea Military Demarcation Line proposed by North Korea. The fifth part will handle the Yellow Sea Navigation Order of 2000. The seventh part will investigate the Yellow Sea Peace Area proposed by South Korea. The final part will analyze the Proliferation Security Initiative and the NLL.
