「경관법」상 경관협정제도의 개선방안

그 동안 무분별한 개발로 인해 우리의 정주여건이나 도시환경은 매우 불량한 상태이다. 그러나 최근에는 국가 간 경쟁과 교류가 활발해지면 국토의 개발 패러다임이 지속가능한 개발과 친환경적이고 인간적인 도시의 건설로 바뀌어 가는 추세에 있다. 또한 국민들도 경제발전에 따른 삶의 질 향상욕구가 증가하고 경관에 대한 관심이 높아지면서, 아름답고 쾌적한 국토 및 지역 환경 조성이 필요하다는 인식이 확산되고 있다. 이러한 변화는 2007년 「경관법」 제정의 배경이 되었으며, 이를 통해 자치단체가 본격적으로 고유의 자연․역사․문화경관 보전을 위해 경관계획을 수립하고, 경관을 체계적으로 관리할 수 있게 되었다. 「경관법」의 주요내용은 “경관계획수립”, “경관협정”, “경관사업”에 관한 것이며, 특히 경관계획실현을 위한 경관관리수단으로서 경관협정제도는 그 동안 일반적으로 시행해 왔던 규제방식이 아니라, 주민자치의 실천 전략으로서 지역주민들의 참여에 의해 아름다운 도시를 가꿀 수 있도록 하는 자율적․형성적 경관관리제도이다. 따라서 경관협정제도가 우리사회에서 실질적인 경관관리수단으로 정착될 수 있다면 앞으로 국토관련법 전반에 주민참여를 확대할 수 있는 원동력 될 것이라는 점에서 의미 있는 제도라고 할 수 있다. 그러나 「경관법」 제정 이후, 지방자치단체에서 수많은 경관협정사업들이 시행되고 있으나, 많은 혼란과 함께 경관협정제도의 실효성에 의문이 제기되고 있다. 따라서 경관협정제도가 본연의 취지에 부합되고, 주민참여에 의한 경관 관리·조성 제도로 정착할 수 있도록 법제도의 개선이 필요하다. 개선의 기본방향으로는, 우선 「경관법」과 다른 경관관련법들의 정합성을 확보하도록 하고, 경관협정을 운용함에 있어 비현실적이거나 미비한 규정들을 개정하여야 할 것이다. 이와 함께 자치단체 및 주민 모두가 「경관법」의 취지를 이해하고 경관협정에 적극적으로 참여할 수 있는 다양한 기반제도를 마련하여야 할 것이다.
Abstract
The policy pursuing rapid economic growth has brought the material abundance. But in recently, the paradigm of the management of local or urban area has been changing. And people began to recognize that the environments and landscapes are the common property of residents and turn to their eyes from expanding the new urban areas to revitalizing the constructed cities. So, Korean government is developing actively the landscape policies and projects. And the Landscape Act, the first statute which is comprehensively regulating landscape issue became effective in 2007 in Korea. By the local government being able to establish the landscape law for itself, it is now possible to manage landscape in a way that is systematic and suitable for the local characteristics. The Landscape Act has been established such as landscape plan, landscape business and expecially, has adopted the system of Landscape Agreement as landscape management. the business to form unique landscape that is harmonious with the local characteristic can be made by voluntary participation of the residents based on the landscape agreement. Therefore, the objectives of the study aims to systematically readjust the existing landscape agreement system of Korea, in expect that beautiful and attractive landscapes reflecting the characteristics of local environment could be conserved.
