한국사회의 민사 법률구조의 이념과 현실

이 논문은 한국사회의 민사 법률구조 시스템의 이념과 현실을 살 펴보려는 것이다. 법률구조의 이념은 ‘법의 지배’로 인해서 법에서 배제될 수 있다는 아이러니를 극복하기 위해서 비용부담이 없이도 (또는 저렴한 비용으로) 법률서비스를 이용할 수 있게 하여 온전한 ‘법의 지배’를 이루고자 하는 것이다. 법률구조의 이념에 대해서는 헌법적으로 법률적으로 충분히 구현되어 있다고 볼 수 있다. 그러나 민사 법률구조의 현실은 그러하지 않다. 정부의 민사법률구조 관련 예산은 전체 예산의 0.012%에 불과하고, 구조 대상자 1인당 예산액 은 1달러에도 미치지 못한다. 정부와 변호사단체는 법률구조에 대해 서 립서비스만 할 뿐 무관심으로 일관하고 있다. 또한 민사 법률구 조 서비스의 공급은 공적기관인 대한법률구조공단의 독점체제로 운 영되고 있고 민간법률구조 서비스는 매우 위축되어 있다. 그럼에도 1990년대 이후로 민사소송의 제기는 폭발적인 양상을 보이고 있다. 하지만 민사소송에 참여하는 국민의 82.4%가 변호사의 대리 없이 즉 법률서비스를 받지 못하고 소송을 수행하고 있다. 한국사회의 민 사 법률구조의 이념과 현실은 심각한 수준으로 괴리되어 있으며 보 다 근본적인 문제제기와 개혁방안의 제시가 요청된다.
Abstract
This paper is written for the analyzing the idea and reality of the civil aid system in Korean society. The idea of legal aid is to achieve wholly the rule of law through providing a free or low-priced legal service, for overcoming the irony to be excluded from the legal system on account of the rule of law. Korean constitution and legislations embody sufficiently the idea of legal aid. But the reality of civil legal aid doesn't. The government budget of civil legal aid is nothing but 0.012% of total budget and the budget per person that is a target of the civil legal aid cannot hold a candle to 1$. The government and the lawyer associations just pay lip service and are indifferent to the civil legal aid. And the supply of civil legal aid service is monopolized by the Korean Legal Aid Corporation that is a government agency and the nongovernmental civil legal service is greatly contracting. For all that filing a civil lawsuit has exploded after 1990s. But the 82.4% of litigants perform lawsuits without helping of attorney-at-laws. The idea and reality of the civil aid system in Korean society is alienated keenly. Therefore the fundamental reform of civil legal aid system is requested.
